that they can not contact the person via certified letters and phone calls. What happens now? As i stated 2 her insur company, i do have proof that the the lady did indeed hit me-*text msgs and her own handwriting*.
The accident *minor* happened on feb 14th. if that helps any.

When you obtain insurance, you sign a contract. Part of that contract states that the insured (person being insured) will cooperate fully with the insurance company in the investigation of claims, etc. What sounds like is happening now is the insurance company is unable to contact their insured and are denying coverage. They aren't going to simply take your word for it. They have the right to interview their client and investigate the claim. If they can't do that, then you will have to sue the other driver in court to force them to pay for your damages. You might make the claim from your own insurance company. You'll have to pay the deductible, but you should get your vehicle repaired and then they will probably go after the other driver. |

Doesn't matter -- the owner of the policy has to file a claim and if her insured can't contact her then it's up to YOUR company to handle the claim then sue the woman for the money. That usually wakes people up and they then rush to the phone to file a claim. |

Without all the jargon and explanations into stuff that your not requesting. If this is the case, did you file a police report and have police present ?
If the other person has "active" insurance, you are in-titled to repairs regardless. If the insurance company starts to play games, get a lawyer. Now the insurance company will comply. |
