Insurance company of the person who rearended me?

I got rearended two days ago. The at fault person's insurance company representative and I had a meeting. She asked me if I missed any work. I said yes. After I told her I missed two and a haf days of work and we calculated the payment. She said I would be paid 900 dollars for missed work. Then she add a little bit for pain for me and myself so the total her company is going to pay is 1,200. I believe this is too low. I will be still going o the doctor and missing work so it will not be just those two days. I asked her time to consider. Did I do the right thing. Can I request more money?

How bad was the impact? if there was minimal damages they will consider a minimal amount of treatment and lost wages.

You can request more money however the insurance company will not consider increasing their offer unless you substantiate the request.

If you are THAT hurt, wait til you are done with your treatment to discuss the injury claim.

You should get an order from your doctor stating that your treatment will be ongoing. Photo copy the letter and give the agent the photo copy. If the agent declines an ongoing settlement, tell the agent you will be speaking to an attorney. Go and get an attorney.

You can do one of two things, wait until your treatment is complete and the doctor releases you. Then you will know exactly what your expenses were. Option two is to discuss it with the doctor and get an estimate of the number of treatments more you will need to be released, and have him put that into written report form.

While you deserve to be compensated for your loss, you didn't win the lottery here. What they are offering sounds very fair to me. Your own insurance agent would be the best resource to ask questions of.

You did do the right thing is in asking for time to consider the settlement amount. However, you do need to factor in a few things
1. How hard were you really hit? - Impact determines about of damage as well as settlement amount - if you have a scratch on your bumper - get back to work and stop faking it - but if you have a substanial amount of damage then okay go to step 2
2. How many times a week are you going to the doctor and how much work are you really missing? are you going to the doctor for only a few hours but taking the entire day off??
***You need to remember, pain and suffering doesnt have a price tag, the rep has a range that they need to go by, maybe she gave you the low end of the range, so if you ask her to give you a higher figure - make sure you can justify why you think a higher figure is necessary.
If all else fails - get an attorney but remember they do take a good portion of the settlement amount - and you'll probably be getting the same amount in the end after a few months

P.S $900 for 2 days of missed work is a lot - Think about how much you really make a day

You have the right (and they have the responsibility) to recover for all damages you have actually incurred. You have the time to consider, especially if you have reason to believe you are still treating. They should know this as well. You did right for asking time but you should also tell her why. She should understand and request your medicals from your treatment for review to confirm that they are related to your accident. Additionally, anything more than those first couple of days off from your work, you will probably require a note from the doctor to explain why you need to be off. It's standard documentation needed for a claim file. I'm somewhat surprised that they were making an offer so early. Was it a light impact accident? She may have been offering that because of that. Otherwise, just have that discussion with her. It's completely reasonable and they owe that.

NEVER accept an offer from an ins co rep,its their job to lowball the payment in order to save them money.get a lawyer,they know how to deal with ins co's,and you will get a considerable amount of money above what was offered to you.Most lawyers dont charge unless you get a settlement,so there is no upfront money involved.
