Insurance company wants check back!!?

If I understand your question correctly you got paid for the damage to your vehicle by your insurance company and then the other persons company also sent you a check. You can't collect twice on the same claim. You have to send the money back to your company.

Just because you pay for car insurance doesnt mean your "entitled" to double payments. You dont get money for being in an accident.. you didnt win a prize. you get money tot ake your car to preloss condition. You pay for coverage to your vehicle in case you are at fault or the other driver leaves the scene or theres a coverage issue at the other carrier.. or anything else that makes you not be able to go through the other drivers carrier directly.

You better send them that check back... they dont play around with suspending licenses etc.

If the other party's insurance company paid for the damage, what exactly makes you think you're entitled to be paid for the same thing TWICE?? Return the money. Thats called insurance FRAUD, if they suspend your license be thankful thats all they do.

Not in my state they can't. They could sue you in small claims court, but only the DMV or a traffic court judge can suspend your license.

Probably best to err on the side of caution but (in Ireland anyway) there's no way in hell that the insurance company can suspend your license. Your existing policy could be cancelled and because all those insurance companies are in cahoots, it'll probably be pretty difficult to get insured again. Technically, you would be in the wrong to not return the check under the principle of contribution which you agreed to respect when you took out your policy.
You could always write them a letter telling them to get stuffed...I can't imagine it would go down too well though.

If the car was damaged take it to a repair shop to the dealer there usually the most expensive get a quote and submit it with the request for there money.make sure the amount is more than the 400.00 dollars by law they have to except the claim or deny because they already paid you.Dont let them bully you if you been paying your premiums.

I don't think they can do this. Why would they? You were the one hit by someone being a hazard with a tire in the back of their truck. You are entitled to that check. I would go to the insurance company, and nicely ask them why is it they're wanting this check back. Explain your situation to them (as nice as you can) and let them know you don't think this is fair. You are not the one at fault here. Good luck to you!
