Insurance issues regarding stolen car?

Hi, I have several questions. My car was stolen from a repair shop, I understand it's routine for insurance companies to investigate me as well but, I don't feel it is fair for the repair shop's insurance to request me to be fingerprinted (I'm willing to go but on the other hand why should I be treated this way?)plus dig into all my personal and financial info, it feels as though I'm being stripped naked while the actual criminal is roaming free. Would you help me know my privacy rights. They are also refusing to give me a rental car during the mean time, so I sit stranded at home. I don't appreciate it that they keep telling me to file a claim with my insurance, I don't think my insurance should have to deal with their liabilty on these matters. They also mentioned very oddly that the responsible party is the thief that actually owes me. This is inane since the purpose of insurance is to recover loss. These are the problems that I have an hope you can guide me with a solution for them. Thank you very much for any help.

I don't know what the final claim outcome will be, they are still investigating first.

1. Privacy- they can ask for any information they want. You aren't required to provide it, but they may deny the claim if you are uncooperative. Which means you'll have to take the shop to court.

2. Rental car- remember this is not your insurance company. They have no desire or reason to accomodate you. As a matter of fact, they will try to settle this for as little as possible. It's what they do.

3. Your insurance company - call them they, unlike the other company, want to help you. They should help you work with the other insurance company to speed things along. There are a number of ways they can help which I'm not going to go into detail here. Just call your insurance company, explain the situation and you'll be amazed how much quicker things progress after that.

Your claim should be filed with your company, they will pay and collect from the other company. The insurance company can't do anything with your fingerprints as far as I know. If fingerprints are needed, the police should be the ones asking. If you have replacement transportation coverage on your own policy you get a rental car, period. Your insurance company will bill the other company for that. If you don't have that coverage, you are on your own for that part of it, sorry.

First, report this to your own insurance company and ask them for advice as to what to do with the repair facilities insurance company requesting you get fingerprinted. As to a rental car, yes, file a claim with your insurance, and they will go after the other company to get reimbursed,

You have the right to refuse to be fingerprinted, but it wouldn't look good if you did. For that matter you can refuse to cooperate in any way with them, but again it wouldn't look good and will just make the process last longer.

IF you need an attorney, your insurance should be able to represent you regarding that also.

I wish you well with this, it's a shame the victim gets treated like a criminal.

When you signed the repair order, you may have agreed that the shop is not responsible for fire or theft, and may have waived your rights in this situation. Insurance fraud is a huge crime and it happens all the time, that's why you are being asked for fingerprints, but it's your car, and it doesn't take Sherlock Holmes to figure out your prints would be all over the vehicle. Contact your insurance company and you can probably get a rental through them.

well im not sure if i can help or not but we had a truck stolen off of a car lot(we were trying to sell it) a few years ago and we just turned it in and our insurance payed it off but i understand what your saying about it not being your fault and the shops insurance should be liable. i guess i never thought of it back when it happened to us. i can sympothize with you tho because we had a fire loss at our business last summer and the insurance will treat you bout like a criminal until they are sure you didn't do it...they just try in every possible way to not have to pay....sorry this has happened to you..hang in there but dont let them push you around either...
