i was in an accident in boston mass in january, i was coming down a hill hit a patch of black ice. the best i could after that was avoid other peoples parked cars, i managed to get it up on the side walk and not hit the fence. i damage my door and the front bumper. proggressive insurance paid the damages but now they have filed a surcharge on me at the registry saying that i was more than 50% at fault. the agent that deemed me at fault some how managed to send my surcharge notice to the wrong address or so he claims and that has resulted in the passing of my 30 day period in which i can appeal. does anyone know how it can be decided that it was more my fault than the conditions at hand and any laws that i can site to have this taken off my record. the sad thing is i have been driving for over 18 years and except for one ticket a clean record and now in this situation they have no consideration for that. they are just doubling my rates as if i'm some habbitual bad driver.

Regardless of street conditions, you are responsible for keeping your vehicle under control at all times. While you might be able to protest the appeal notice, you very likely will lose because of your failure to control or more specifically, traveling to fast for conditions. This is why the accident occurred in the first place.r |

You should be able to contest it because of their error. As far as fault, you should have been more cautious while driving in winter conditions. I think they have you on that one. |

It is expected to drive to conditions, and that a driver maintain control of the vehicle, and that includes black ice conditions.

With all due respect. Who do you propose blaming ? Whose fault do you think it should be? . Should it be the fault of the "ice" ?, the curb, ? The weather? God ?. Geez....
