because it is a law in washington state that you must have auto insurance on your car that you drive, if you were in a wreck and it is the other drivers fault.the person at fault is insured and you are not insured who is really at fault here.

Little Mama is incorrect; lacking insurance does not automatically make you responsible in case of an accident. You mention that the at fault driver has insuance, and it should take care of the other driver's damage/injuries. That driver's lack of insurance is a criminal matter, the crash is civil. |

If you don't have insurance, you would need the police or witness testimony to prove your case and win against the insurance company. You will be fined for not having insurance, but that does not mean you are automatically at fault. If you drive away from the scene (hit and run), you are automatically at fault.

the fact of FAULT has nothing to do with who has insurance and who does not. FAULT is FAULT. If you hit someone who has no insurance then you are responsible as well as legally liable for these damages. This is true in Washington. There is ony one state that i know of where if you do not have insurance you cannot collect but that is different than fault. |

The person who caused the accident will be charged with the accident and the person with no or expired insurance with be charged for no valid insurance. |
