No. he owes you the MONEY, not the repairs. You can take the money and fix your car, pay bills or buy crack -- it's yours to do what you please with. May as well get ready to file a claim under your own insurance or sue... this guy isn't going to pay you one dime.

No different than if you took him to small claims court, won the judgement, do they make sure you get the car fixed? you are out money because this person failed to comply with law. You dont even have to get the car fixed, shoot, you could trade it in for a new car and use his cas as the down payment.

Personally, I believe that my life is being shortened because uninsured drivers are using the food, water and oxygen that I need to survive.
I suggest that you get a good lawyer and take that Rotten Creep for every thing you can.
Suppose you had been injured,"does he have a doctor that would fix YOU up?"
Uninsured drivers force every one else to assume the risk for their behavior. It's unfair, its dangerous. And No its not blackmail to ask to be compensated for the damage he caused you

if your mechanic is fixing the car for close to the amt his mech is ,than tell him whats the problem.--explain to him if im not satisfied with my body man its on me.--but if i use yours than this can get ugly.--u dont want ugly

First of all, the right to choose a mechanic for repairs is YOURS, not the driver's. Think about it...if it were the driver's choice, he could choose some cheap blackmail chopshop who may not even know how to repair a car, say it cost way below what it really was, and then only have to pay you a little bit.

It's not blackmail, per se. Blackmail implies using threats against someone in order to extort money.

It IS, however, unethical of you to ask the uninsured driver for funds that you have no intention of using to actually repair your car. What that actually constitutes is called FRAUD...receiving money for a specific purpose and using it for personal gain or something entirely different instead of what it's intended for.

What you need to do is to ask your buddy what the cost of the repairs would be, and then present the uninsured driver with the repair estimate as he would for any customer, and then demand the uninsured driver pay your buddy for the repairs.

If, after that, your buddy chooses to "gift" you the money it cost the driver, that's his privilege to do and it would be perfectly ok for you to accept such a gift.

But it would be wrong for you to approach your buddy with a request for free work, and then take money from someone else without disclosing to everyone what you're going to do.

He is not required to pay you cash. His obligation is to make you whole, the same as an insurance company would do. Are you threatening to turn him in for driving with no insurance unless he pays you cash? That would be extortion.
