Is it possible to sue a car alarm company if car is broken in and alarm didn't sound?

You can probably get a free consultation with a lawyer and find out for sure. He might even take you case for free, for a share of the winnings, if they are going to be substantial, that is if you'll sue for something other than your car sterio. Like false advertising or emotional damages or something.

CowboyBill
Get a grip, crybaby. A theif damaged your car, not the alarm people.

Robert B
I dont know if you can sue them but they should have some sort of gaurantee contact the manufacture and see what their willing to do for you

bostonianinmo
You'd have to prove negligence on the part of the alarm company to succeed with that. Most alarm systems can be defeated by an expert.

Unless you're talking about some serious uninsured $$$ losses -- a Roller or a Maybach for instance -- it's probalby not worth a lawsuit. And if you were driving something like that without insurance, well, no need to comment on that, right?

lol no thats so funny you people buying car alarms if a theaf wahts his gonna get it he might even make off with the alarm system. they steal the automaic starters what ever the want best thing to do is dont leave nothning in site for them to want to take but a little flasing red light for the dash. its cheaper than a whole alarm system

If the company claimed that the alarm could not be bypassed or otherwise fooled, then yes you have a claim. But, generally, no you have no real recourse. That is that real thieves do for a living, they get by alarms. And even if they didn't, I know I dont look when an alarm goes off anymore.

oklatom
Absolutely. In this day and age, you can sue anyone for anything if you find a lawyer willing to take the case. Would you prevail? Was there something in writing saying "This alarm will sound 100% of the time with any attempt to break in"?

The truth of the matter is, they don't do much good when they do sound. I tow cars, and often times the alarms will go off and continue sounding for a time as I get the locked doors open and disable the alarm, and for the most part people ignore them. Sometimes I have driven for miles with the car on the hook flashing its lights and sounding the alarm, and have never been stopped or questioned.

I WOULD DEFINITELY TRY TO SUE FOR DAMAGED ALARM AND FOR THE ITEMS THAT WERE STOLEN. WHAT CAN YOU LOOSE FROM TRYING.

MoltarRocks
Who installed it? You probably need to go after them.

Was it tested upon installation? (i'm guessing this is an aftermarket system)

Probably, if someone can sue mcdonalds for their coffee being to hot I don't see why not if you need a lawyer go to findlaw.com

champ2785
Sorry about your misfortune. I would read all of the companies warranty claims, some companies claim they are burglarproof. Be prepared to prove that it was installed properly. Depending on the amount of theft or damage, small claims court might be an avenue. You might try calling their customer service and see if they will offer something to avoid litigation.

Yes , whether you win the case or not will be a different story. You can take them to small claims court with out a lawyer , unless they decide they want a lawyer , then it has to go to civil court , where you both need a lawyer. Take your contract to a lawyer and see if they would take the case.
