So...rather than brake to avoid the construction... the guy in front of you should have just ran over the construction/equipment/workers etc so that you would not hit him in the rear? See the problem with this?

You were following too closely. You are supposed to keep enough distance between your vehicle and the car in front of you that the front car can make an emergency stop and you not hit him in the back.

I am assuming you hit the guy in front of you in the rear. If so, if your insurance company gives you a letter to take to court saying they paid the other guy for his damage/injuries, then there is a good chance your ticket will be dismissed or reduced.

when you hit someone from the back you're always at fault. that's why you're supposed to keep a 3-car distance from someone in front of you.

You are obligated to keep a safe stopping distance from the car in front of you. The only way you can get out of this is if you prove fraud on his part (for example, he hit the brakes for no reason just to get you to crash into him).

No its not always an open and shut case. If he cut you off, thats impeding the right of way vehicle, or if he slammed on his brakes for no reason (break checking). The second one is hard to prove, and insurance scammers use this one a lot.

Yep, if your front hits someone else's rear, you're instantly at fault. No questions asked.

Well, if you hit his car they will see it as your fault. They'll say your were tail-gating.

It is understood that the driver behind is liable for rear-end accidents (for the most part). It is the responsibility of the driver behind to maintain a SAFE distance from the car ahead of it.

That is why, even if you are stopped at a light and you get rear-ended, that the person ahead of you that you struck would be your reponsibility. I had this happen to a friend. She was waiting at a turn signal and she was rear-ended. Because my friend did NOT maintain a safe distance from the car ahead of her, SHE was reponsible/liable to the car that she hit. My friend even got whiplash, but her insurance had to pay for damages to the car she sat behind.

That is the purpose for the rules of thumb about how many car lengths to have between you and the car ahead of you, to avoid such situations. (Number of car lengths, or X-amount of seconds to pass same item in road to mark safe distances).

You have to give the guy infront of you enough space between him and you so you can stop. It was your fault. Maybe you shouldn't have been so close to his tail. You can not get out of your ticket. Sorry. Even if he was testing his brakes, you should have had enough time to stop. What if that was a deer in front of him?

First you got a ticket. It was for following to close. You fail to follow the rule of the road. Stay offthe other guys bumper. In other word stay back away from back of another car. Where you have time to stop without hiting the vehicle in front of you. The only way you would not be at fault, Is that he back into you.
