In 2006, I let my boyfriend drive my uninsured car and another vehicle crashed into him. Now we are both being sued by the other persons insurance company.
I live in Indiana where the law is: it's not automatically the fault of the uninsured person.
The police report is in favor of me. So I don't understand why i'm being sued and what are the chances of me winning the case?
So basically, if anyone has any experience with this please help!
Additional Details
Also...I am in the middle of filing bankruptcy...should I mention this in court? And will it have an effect on the case?

You are being sued as the registered owner of the car and negligent for not having insurance.
Your boyfriend is being sued for driving an uninsured car as he is also responsible to make sure the car is legal before operating it.........Chance of winning......slim................../////... bankruptcy makes no difference .........................md |

Fault is not determined by whether one has insurance or not. However, anyone can sue anybody at anytime for anything. You are being sued because you didn't have insurance. The judge will determine whether you have to pay or not. You have little choice. You have to defend yourself in court. Either by representing yourself or by hiring a lawyer to represent you. The bankruptcy has little effect. except...... If they find you are filing, they may back off because they should know even if they win, their chances of collecting from you are slim to none. With all due respect. The computer you are using now and it's related expenses, if sold, could go a long way towards buying insurance for your car. Don't you wish you had done that before the accident ? If you had, Your insurance company and all of their lawyers would now be defending you for free., |
