Is this shop responsible?

I had a hub assembly replaced on my car and about a week later the tire flew off while I was driving. No one has worked on my car in a long time other than this shop. There were no lug nuts to be found! We found the tire, took 1 lug nut from the other three tires and pulled out the quarter panel for me to get home. Tried speaking the the owner of the shop and I was told "It's not my problem....do what you feel you need to do!" He had many excuses...said that the bad lower control arm caused it...bad bearings and also the "cheap" part that I brought him to put on caused it. But these parts are still on my car and I am able to drive it. What do you think? Is this shop responsible??

I believe they did not tighten the bolts. His repair license from the state should be posted for all customers to see. Get the license number. The mechanic's license number that worked on your car should be on your receipt and also posted in the shop. Get the number. If not, ask the sales person or owner for this information. Then write a letter to repair shop including this info and send it certified. If he does nothing call the BBB and report his shop and the mechanic. File a report with the state about what happened and give detail. Make a file for all your written documents. The shop owner should be more afraid of state than the court especially if he is not in compliance. He could lose his license. Last step if not satisfied, file a small claims action and make triplicate copies of all written evidence for court day. Good luck!

As suggest, send the shop a letter. Tell them you want to file a claim, and they should refer the matter over to their insurance company. You want to get his insurance company involved. They will complete an investigation and determine who, if anybody, was negligent. The shop should have a Garage Keepers policy which would cover this loss assuming they are liable.

If the shop refuses to refer the matter, file a small claims action. Your insurance company will not hire an attorney for you. However, you can file a claim and they will attempt to subrogate to recover what they paid out plus your deductible.

Send him a letter that requires his signing a receipt, registered or certified, whatever is cheaper, and tell him you are taking him to small claims court. Then see what his disposition is.

They apparently forgot to torque the lug nuts. You could also contact your insurance company to see what they have to say. They do employ lawyers.

I certainly wouldn't drop it.

I would speak to the better business bureau and if the shop is certified, speak to the bureau in oversight of the shop. This will cause them to start looking at the shops practices and might shake the owner up enough to work with you. You can also go to small claims court but you need to have all of what you are reporting documented and backed up with witnesses.

i would call the better Business burro and talk to them sounds like he needs to be checked out
