I have just bought a car from a dealer and he promised to have all DVLA documents when picking the car up, when I got there however he said with the bank holidays etc he hasn't received it yet and promised it would be sent in a couple of days, I felt suspicious and said about needing it in case it has been in a crash or had finance left and he said he was a reputable dealer and none of that is a problem with this car, so I paid the rest of the car off with cash, when I got home I did a HPI check and it was written off 2 months ago and given cat c. I have since called him up and he said he didn't legally have to tell me outright. He has offered the money back minus £160 for his time.................? Ive got him down to £100 and am collecting the cash and returning the car tonight. I don't think its right he gets away with this but I obviously want my money in my hand before investigating this, does anyone know if he was in the wrong and it is worth looking into? I know alot of cars are fine to be driven as a cat c but my point is I was never told and am not wanting to drive my kids in a car that has been fixed. Thanks for any help.

Sorry to say it's a bit late to do an HPI check AFTER you've bought the thing, you really should have done it before then you would have known. Did you specifically ask if it had been written off? If you did and he said no, you have a proper case against him.
A dealer is required to see that the car is "fit for purpose", i.e. does what you'd expect a car of that type and age to do, and to answer your questions truthfully. If you don't ask he doesn't have to tell you, I'm afraid.
You've done well to get most of your money back, I'd leave it at that.
By the way, there may be absolutely nothing wrong with the car at all if it's been repaired properly, there are many thousands of cars on the roads at the moment which have been damaged and repaired - have you asked someone in the know to go over it for you? |

If the car was properly repaired by a qualified Vehicle Repair Technician in a professional repair shop it is probably OK anyway BUT a cat C car has had quite substantial damage and to not declare it to a purchaser is sharp practice. Pay the 100 quid and be pleased that you got out of it that cheaply and put it down to experience.
My youngest son is a qualified vehicle repair tech in a manufacturer approved body shop and has often repaired a cat C write off to new car standard but comments that if he was to be buying one himself he would want to know just who and where the repairers were. |
