Loss of wages due to auto accident?
|
I was contacted by the at fault person's .insurance company and they want me to give them an estimate of how much will be the loss of wages due to the auto accident. Iis there an average amount of loss of wages hours in such a case? Is 50 hours too hight a number to give as an estimate? Additional Details My hours are not 'provable" as I am self employed and the loss of wages spans over a month's period

How long were you out of work for? 40 hours/week would be the norm..... multiply that by how many weeks and your hourly rate, and you got your number.
If it was only a few hours, then it would be multiplied by how much work you actually missed.
Try to get the highest number possible without seeming to greedy because insurance will pay out big, but will get too suspiscious if they see you trying to cheat them |

well i guess it depends on how long you were out of work.... i dont think that there is a limit but if you only missed one day and then try to claim 50 hours they might try to burn you.. |

You need to use a normal work week and you may get what you ask for. Those pepole are not stupid. |

About a week?
Does that suffice?
I'd prefer to leave it open. How do you know if there are complications?
There is no average. Each case is different.
Be careful about signing a "Release" if your doctor sees any future consequences. |

Then you'll have to go by last years tax returns, divide annual figure by 12 to get a monthly figure, and prorate it up to cover your exact days, with a small increase for inflation. |

Seeing your are self-employed I would surggest taking your salary from the last six months. Add the six months salary together, divide it by six and that would be the number you would give the insurance company as an estimate of a monthly salary figure.. |

Ok just BE HONEST here they will go to your employers for work records so don't try to screw them as it will come back on you ! If you were out one day then say One day don't lie !!!
People that Lie and screw insurance companies drive the insurance premiums up for all of us !! |

That depends on how bad you're hurt. If you feel that you can return to work after about a week, then tell them the 50 hours, but if your injuries are going to take more time to heal for you to be 100%, then you would need more time to recooperate. |

If that's how much you have assessed that you will lose then tell them.
Be warned if you lie and over estimate they will probably check if they are any good at what they do.
Because of what you have added speak to your lawyer and let him advise you. |

Basically give them the loss of working hours to completion of the repair. |

Hiya:
If you are self-employed and don't have 'provable' wages...you will have to submit earnings statements - what you submit to the federal government.
is 50 hours too high?
Well - is that the truth? Or are you trying to inflate your wages/settlement.
Don't try to get ahead of yourself....it will catch up with you.

They are looking for the amount of work you missed.... Which they can find out if you are being honest. Dont foget pain and suffering... that would be 2 times medical expenses. |

Do not give them this information!
Unless you have gone back to your regular full time work, you or your Dr. have no way of knowing how long you may be unable to work.
PS. You would do good to contact an attorney, and ask them. Most Attys do not charge consult fees. |

good hours but also count the time it takes to and from work. |

Why are you dealing with the at-fault's person insurance company directly?! Refer them to your insurance company, or better yet, your attorney!
Also, if you claim loss of wages in your lawsuit, do you know that your entire award becomes taxable? |
