If the other person didn't want to pay for the damage to your car, she shouldn't have hit you. There is no reason why you should have to shell out the deductible to get your car fixed when it wasn't your fault.
Please tell me you got a police report. Without it, it is going to be your word against hers. She could tell her insurance company that you are full of it. Guess who they would believe. |

Sounds like the accident was her fault. Get an estimate and decide. A few scratches will reduce the value of your car and could cost hundreds of dollars to repair. Why should you pay for her mistake? If the accident was her fault there is no deductible, her insurance company pays for the complete repair. You can wait for her insurance company to pay and pocket the money or fix it, or fix it now out of pocket and wait for their check. It won't affect your insurance now but you should be aware that a number of accidents over time even though not your fault can get you classified as a risky driver.
If she has your information report it to your insurance company. Your insurance company needs to see the damage to her car, if any. What if she has an accident in the future and says the damage was from this accident and that it was your fault? Your insurance company would have no proof that it wasn't true. There are dishonest people in the world. |
