Minor accident she was talking on her phone (illegal in ca)...?

when she abruptly stepped on the brakes. i rear ended her going 10 mph. she complained of minor whiplash. there is a little paint chip to the bumper. no damage to my car. no police report or witnesses . when i try to call her she never picks up. if she was talking on her phone is it her fault for negligent driving? if there was no witness or report could i just claim no fault?what would be the best course to take?

You are almost certainly at fault. You rear ended her and it makes no difference that she was talking illegally on a cell phone. Why would you try to do the work of calling her yourself ? Don't you have insurance? If you do, let them do the job you pay them premiums to do. Call them ASAP! |

I don't know. Usually, when you hit a person in front of you, it's seen as your fault no matter what because it shows that you weren't the proper distance away from her vehicle while driving down the road. Technically, you're supposed to be a car length away for every 10 miles per hour in good driving conditions. Of course, nobody really does that. Lol. |

Even though she was talking on a cell, it does not change the fact of fault. If there was a police report, she may have gotten a citation for the cell, but that's it. This is why you keep some space between vehicles when your driving. |

even though she was not fully alert you were at fault because you failed to reduce speed to avoid an accident a report shoulda been filled
and if she really did have whiplash then she would have had one filled out so i wouldnt worry about it.. |
