There was a minor car accident. The other party was backing up when he hit my stationary car. The party agrees to pay for damages. No report filed. I got his insurance information. After showing my car to mechanic, the party decides the cost was too much and will not pay. Contacted his insurance company. After 5 days and no word, I contacted his insurance company and they havent heard anything from their insurer yet. What should be next steps and whats happening? I am totally ignorant as this was my first accident case. Any help/inputs appreciated.

thanks for your responses. There was police on the scene. However, he adviced that the other party accepts fault and willing to pay and so its upto me. I was naive and believed the cop and didnt file report. I contacted my insurance and all they did was contacted him and later his insurance company. He did confess to my company that he was at fault but was not willing to pay for damages. He hasnt contacted his insurance company so far. I have the officers name and batch number.

You need to contact your own insurance company and let them do the work you "hired" them to do. This is a perfect example of what happens when you try to"settle on your own". Never, ever try to "settle on your own" |

Next time be sure to call the police and have them file a report, regardless of whether the other person wants to or not (especially if there's even a small chance that the accident wasn't your fault). Live and learn.
I'd keep hounding his insurance agent (like several times daily) until you get some sort of response from them either way, but there's a good chance the other person will just deny everything at this point. It would help if you had a witness to the accident (if there was one besides you and the other person...) but with no witness, no police report, and if the other driver denies hitting you you might get stuck paying for the damages yourself unless you take him/her to small claims court.
In small claims court you'll have to prove that you were hit by the other person somehow etc., and it might end up being another case of your word vs. theirs. It's up to the judge at that point. If there was any paint transfer (or if you can somehow get a picture of the damage to their car) that's a good place to start to support your case. Good luck. |
