Mistakenly excluded from Wife's auto insurance-had accident?

we were rear ended at a red light last March. I was behind the wheel though stopped. My wife had mistakenly checked the box excluding me from her AAA policy. Our lawyer told us it wouldn't matter since we were not at fault but now other drivers insurance says all they need to cover is our medical bills, no other damages.Our Laywer isn't sure but doesn't want to pursue further. Why does it matter if I wasn't on her insurance since we were hit? also I had my own insurance,,shouldnt that cover me in any car I drive?

It's impossible for you to be excluded, you have to have a minimal of liability and that includes anyone driving the car who hit somebody, it doesn't matter if she checked you off the as a liability.
You can't have the car on the road without it.
Now don't mistaken me for what you are saying I totally understand what you mean.
What it was your wife check off was that "your car" wouldn't be insured if you were at fault, but would still cover the other car; but since you weren't at fault it's not even an issue.
The other insurance guy is just trying to see how much of a pain in the *** he can be, some people will try to forget the whole thing, and that is what he hopes you will do, because it does work, don't fall for it.

In California, the driver needs to be on the policy for that vehicle he/she is driving. Its state law. If you had your own insurance but was for another car it would not mattered. For you are only covered for the other vehicle and not the one you got in an accident with. The fact that the other drivers insurance is only willing to cover medical is probably the best you can get out of it. If I were you I would get the best medical you can get. |
