Mot and insurance problems?

friend was drivng her car, out of a minor road, in to a main road, and hit another car, her car is a right of, she was told to take details to police station in seven days when checkng her mot certficate, found it was 10 days out of date, will she stlll be insured and what is she looking at from the police, it was an honest mistake, live in uk

Having no MOT usually voids insurance. So potentially, driving with no MOT, driving with no insurance and careless driving.

The lack of MOT does not automatically invalidate the insurance.

An insurer can walk away from a claim if the MOT has expired and especially if it can be shown that the car is in poor condition and would not have passed an MOT.

As they forget to renew the MOT by a few days because they genuinely forgot, they may still be covered.

The quality of the insurer, the influence of the broker and the size of the insurer's goodwill would be a factor.

an mot is a ,piece of paper that only relates to specific items at the time of the test.it does not reflect the roadworthiness of the car at any other time.your friend should get a new mot which would show that the car was compliant with current regulations and not the cause of the accident.as for insurance she needs to read the policy because if insurance companies can avoid payment they will

The only time you can drive on the road without an MOT is on the way to the MOT test centre. If not then she was on the road illegally.

As other people have said the insurance company may not like this in the event of the claim.

Honest mistake or not she is still guilty of driving without an MOT. Honest mistakes are not justification in a court of law.

I think you only get a grace period if the car was booked in to have its MOT done. As she didn't realise this she may face a problem, but she will need to speak to her insurance company and see if she is covered. Fingers crossed everything will be ok.

If she didn't have a valid MOT then she wouldn't be insured. So she is likely to be penalised for driving with no valid insurance and no MOT but it will depend on the insurance company

her insurance company will not pay uot as they look for any reason whatsoever not to pay.they will say the car was unroadworthy due to no mot.the police will press charges for driving without mot and no insurance.it might have been an honest mistake but the police are clear on matters like these,the onus is on the driver to make sure their paperwork is correct.she wont go to jail or anything like that but she can expect at least 6 points for the insurance plus possible fine and 6 points for mot and possible fine.sorry to hear of this.

sorry to be bearer of bad news but her insurance may well be void - despite the so-called insurance expert above (20 years my a ss) the law is clear - MOT must be in force - the exception is driving to an approved MOT station for a pre booked appointment after expiry of MOT (inc after failing original MOT) provided reapirs have been made.

The insurers will be within their rights to make the policy void as the car is deemed to be without legal right to use the road as the vehicle MAY not be roadworthy.

She may also be prosecuted by the police for driving without MOT.

Unfortunately, with the new MOT certificates there is no longer any excuse for 'forgetting'.

She could get done for driving without insurance. Insurance is not valid without a current MOT certificate with most companies.

Check the small print.

I don't understand why somebody got on their high horse because they used to work for the police. It has nothing to do with the police. If your insurance company has it written in to your policy that it will be void without a current MOT certificate, then your insurance will be void. Its as simple as that. There is no universal rules, insurance companies can and will attempt to get out of paying at every opportunity. The only way you are going to be able to tell is contact your insurer to find out if it is a condition on your policy.
