Motorbike collision?

I was involved in a collision on my bike, whereby it was written off and I recieved injuries. I was riding down a main road in line of traffic. On approach to a junction on the left hand side with waiting traffic the car in front of me indicated left. I moved towards the centre of the road to move away from the waiting traffic and to make myself visible to traffic in the other direction, so they wouldn't cut in front of me. I slowed behind the turning vehicle, still in the middle of the road. As it turned a car that had been waiting had pulled out and stopped, blocking my lane, waiting for traffic in the opposite direction to let it in. I could not avoid the collision and rather than go over the bonnet swerved to the left and hit it side on, at about 15mph. The driver of the car i hit says i shouldn't have been overtaking, although i wasn't. and now the insurance are trying to say it is my fault as well. I thought a give way meant you had to give way to oncoming traffic, why my fault?

From the sounds of your description, the car was in the wrong, whether you were overtaking or not. The car driver is responsible for making sure he has a clear access into the main carriageway, which he obviously didnt. You need to ASAP, get any witnesses. Get any reference numbers from the Police, (assuming they attended). Make clear concise drawings of the accident zone, showing vehicle positions, inform your insurance company (should have done right away). It should be your insurers job, to sort out the damage to your bike, however any injury part of the claim, you need to get a copy of motorcycle news and find a reputable accident claims lawyer who will work on a no win no fee basis, or if you are in the RAC, perhaps AA also, ring them, as they sometimes offer free legal cover to members and will fight your case. The RAC sorted a bike accident lawyer for me and although my case took 5 years to sort out, I won Â£7K in compensation. Whatever you do, act quickly and do not put up with BS from anyone...Oh and PS! the insurers will always try to blame you, because they dont want to payout. The guy who hit me was insured by a large UK direct insurer and because I injured my back years before I injured it again in my bike smash, they tried to say the damage to my back was already present and not the fault of the smash!! They are all money grabbing scum and you will need a good lawyer and the patience of a saint Good Luck

You are correct the car driver should give way to traffic on the road he/she was trying to join. I would like to bet that they were not looking for a bike, and this is the reason why they moved into your path.

This is driving without due care and attention!

Sorry, your description makes it difficult to figure out where your bike was in relation to the cars. I'm assuming, because you were injured & there was damage to another vehicle, that the police attended. Why not contact the officers who attended to ask them for their opinion.

I'm not sure if it was your fault, I would have to see the road plan and any marking or signs, diagram of the accident and see who was moving and who wasn't.

Basic rule of thumb as an ex-biker. Watch out for everyone else on the roads - look at their interior mirror to see if they've made eye contact with it or if they know you're there even.

Think like "Everyone on the road is an idiot, make allowances for them!"

You were travelling along a main road.
A car exited a side road, ignored the give way markings / signs, ignored you and crossed into your path of travel.
You were unable to avoid a collision and hit the car.

I'd say that was pretty cut and dried. You cannot be held responsible if the other driver ignored the give way signs at the junction.

Had the car turning left from the main road not been there, what would the other driver's excuse have been?

Oh crap are you kidding! Man oh man that is one of the best questions I have ever saw on here. I want to vent a second I lost 10 points cause this guy posted My friend is hooked on Yahoo answers how can I help her and I put MEEEE TOOOOO HELPPPPPPPPPPPPPPP!!!!!!!!!!!! I dunno what your question is but my answer is DON'T GET A MOTORBIKE! I know is fun but is very very dangerous. I was involved in an accident (a high speed motorbike bumped into the back of the car I was sitting in) and this guy flew to the sky and dropped back down - dead! Wasn't the driver's fault. He drove too fast and went through traffic lights!
