Motoring convictions?

My grandson was done for speeding on the m6 where road works were in progress The car was owned by my son so when he received a letter asking who was driving he duly it was his son & also wrote back that a course of driving awareness may be better than a 3 point conviction A letter duly came back saying yes & a course will be offered A week later a letter arrived saying the authorities made a mistake in offering a course & so the the prosocution will go ahead can they do this aftering offering the course & then changing their minds?

And, by taking the case to court, your grandson is looking at something far worse than just three penalty points.

The courts are taking a dim view of vehicles being driven at speed through roadworks because of the danger it poses to the workers. Your grandson could be looking at a ban and a hefty fine. The court could also order the car he was driving to be seized and crushed, with the bill sent to him as well. That will, of course, teach you own son a lesson as well.

Yes of course they can correct mistakes. The fact that the case is going to court rather than a ticket being issued, shows how dangerous the speed was to the people working on the road works.

Yes they can. Someone higher in the police has maybe seen it and thought a trial would suit the public interest.

The little scroat should have owned up to the speeding offence in the first place ! Maybe getting three points on his licence will serve as a long-term reminder to obey the rules of the road, and he'll think twice about going over the limit next time !

They're quite right, he should be prosecuted and maybe the points on his licence will make him a bit more aware on the road. The fact that his father suggested a driver awareness course is a bit of cheek since the son obviously hasn't been qualified for very long and should have known better.

I drive the M6 regularly and there is more than sufficient warning of the cameras when going into a roadworks section. Serves him right.

Yes they can correct a mistake where it falls correctly into the law. The issue of a driver awareness course is done at a local level and depends on the excess speed committed over the limit and the age of the driver, but again that's down to local discretion. Perhaps your grandson's speed was too high for discretion or his age was against him. The police have a particularly low tolerance of young, newly qualified drivers as statistically they can be a problem ( some - not all! ). I suggest that you simply appeal against the decision ( pronto! ) and ask for reasons in writing for the change of mind. But I suspect that the details of the offence are outside discretion.

It's not always about the offence itself that they send people to Court. Sometime they just want to mess your your brain and your life.

Might be an idea to ask a solicitor for advice on this one. I suspect the police will take more notice of a letter written from a solicitor that points out the mistake.
