He only needs to see the dr again if he is not feeling better and is still hurt. He only goes to the dr b/c he needs medical attention.

He can submit a claim with the medical bills that he has already incurred.

An attorney will take 1/3 of any settlement he gets. Insurance companies do not pay for your attorneys fee's. They don't add to the claim to cover the cost of an attorney. Any settlement you get - is based on the injury you received. Not on if you have an attorney or not.

My two cents - try to work it out directly with the insurance company yourself. The claim settlement process is faster (less people involved) and the settlement only gets divided into 2 pieces (you and medical providers) instead of 3 (you, medical providers, attorney). So you may actually end up with more money handling it yourself.

The adjuster will be able to explain how the claims process works in California. You can also ask your agent questions.

I love it when everyone starts saying "get a lawyer". They have absolutely no interest in what is best for you. You only need legal counsel if the insurance company is not offering a fair settlement. In many instances they will actually offer more than you would get if a lawyer takes their fees out. You need to see what gives before you retain an attorney.

No, he does not. However, he may not be entitled to any monetary compensation. The tort threshold requirements vary from state to state. Some are monetary, some are verbal and in other his injury has to be serious.

If he lives in a state with a verbal threshold, he should be reimbursed the cost of the ER. Don't expect more than $100-$200 for compensation. If the ER doctor recommended follow up treatment he should take the advice.

Oh yeah, I assume he was not at fault and/or does not have any comparative negligence.

Edit - CA has a verbal threshold. They will pay for his medical expenses and likely offer a nominal settlement depending on the injury.

first of all, you do not need to go to an attorney. do not listen to that. what he needs to do is contact his insurance company and let them know what's going on. let the insurance company handle the situation. the other company is responsible for those fees if they are found at-fault in the accident. going to an attorney is unnecessary and a waste of time and money.

Get money?? Everyone's first answer is to get an attorney. Counsel is sometimes necessary for life altering injuries or fatalities. This is not a case where an attorney is necessary or warranted!

Your 'bf' can submit a claim to the liable carriers policy. In Calif. they will make payment directly to the injured party for medical, pain/suffering. Trust me it won't be much, enough to cover medical bills & a small settlement for a soft tissue injury.

Going to an attorney causes grief for everyone! They complicate matters.

The OP's liability will cover damage to your friend's vehicle and injuries BUT the OP's ins co will wait to pay the injuries until the friend is released from the doctor. The vehicle claim can be settled fairly quick.

If your friend has PIP or medical coverage under his/her auto policy, then a claim should be made under that coverage where he/she will get immediate financial relief.
