Your boyfriends insurance company will have to pay for all 4 vehicles, since the accident was his fault. If you live in a state with required insurance, the truck driver may be cited for not having insurance, but his insurance (or lack of it) is meaningless in settling damage claims in the accident. The truck driver wouldn't use his insurance, even if he had it. He will file a claim against your boyfriend, as will the other two drivers.

If it was your boyfriends fault it doesn't matter if the truck owner had insurance, your boyfriends insurance company has to pay the damage.

The only thing it means is your boyfriend is at fault. Peroid. Any rear end collision is the fault of the driver who hits the other one in the rear.

I have to agree with M. It doesnt matter about the truck. In all the states I've lived in, if you rear end someone, its your fault regardless of why. If there's a chain reaction from it, your insurance pays all the damages.

I can't speak for KY, but in WA whoever is found "at fault" has to deal with all damage and medical bills. If you BF rear-ended another vehicle HE will more than likely be the one who has to deal with it, so the truck he hit not having insurance is not an issue. Although he would get a citation for driving without insurance

thats not good, regardless their going to place the blame on someone. And that someone is going to be the one that started it, and that would be your boyfriend. No insurance, means he will have to pay every penny of whatever the court decides. So whatever damage to the other peoples cars, any injuries, everything will be paid by him! And he will have to pay to have his own truck fixed to. Always carry insurance...

I live in Ky. as well, and I've always heard if you hit someone in the rear, it's always YOUR fault. Not being an insurance agent I don't know how true that is. Your boyfriend does have one thing in his favor, he has insurance. I'd say the person driving the truck will be facing some kind of fine for driving with no insurance and may even have his license revoked. Just make a call to your insurance company, they will be able to answer your questions. I hope nobody was injured, and wish you luck.

It depends if the people think they should sue your brother for it. If that happens, then your brother will be liable, not the truck. But some people will just use their own insurances to fix it and figure that it was the trucks fault and when they realise he doesn't have anything to sue for, they will just handle it themselves. But don't count on it, it sounds like it was your brothers fault so he is technically liable for it.

if your bf was at the rear of the accident and "cause" he's at fault no matter what.. It's his insurance that will pay does not matter the other car didn't have any. If the other truck had hit him, then his insurance would pay for his car/injuries only.

It was his fault because the person in the back is always at fault because they are supposed to give the person enough room so that if they do hit the breaks fast, you have enough time to react. Since the guy didn't have insurance, he won't get any money to repair his car unless he sues you. He probably will not however because he'll get in trouble himself for not having car insurance. Hopefully he'll just let it go!
