My bro in law, let his deceased wifes car tags expire...now he wants me too..?

my brother in law doesn't have a valid drivers license. And over the summer his wife passed away. The car is in her name and her parents. In october the tags on the car expired. but it was having some engine work done on it. He claims to have not had the money..(which is TOTAL BS) to get it taken care of until now, which he really still doesn't. he wants to borrow the money from my hubby and i. But he called me and asked. Which in return caused a tiff between hubby and i. because i don't work and i hold all our money..(hubby says that it is then my money my deal because i don't let him hold it and i spend it). he doesn't have insurance on the car, and all he has is the paper where it finally passed emissions. Can i go to DMV and get a new tag for it? How should i handle this. It is giving me ulcers i believe..

His name is not on the title/registration & he doesn't have a driver's license. He has no business having a car. The title is in his late wife's & her parents names. Then the car isn't legally his to do ANYTHING with. the car should have gone back to her parents, unless they gave him the car. In that case, they should have also signed over the title to him.

From a professional view, as long as he doesn't have a license & the car is not even legally his (according to title), then don't get involved. IF he gets the title signed over to him from his in-laws & gets a driver's license, then use your discretion if you want to help.

What state are you? Each state is a little different.

Your question is can you go pay the registration and apply for the tags....Yes, you can do the leg work. Take in the old registration.

Your bigger problem is lack of insurance. No insurance, no tags.

You will probably be asked for Proof of Insurance, since its been without insurance for longer than 30 days, the DMV knows that. They will refuse to give you tags until insurance is shown. In fact, in CA the registration is probably already suspended. In which case you need to make a phone call to 1-866-664-4545 You must submit evidence of financial responsibility and pay a $14 reinstatement fee. This process can only be handled by the Vehicle Registration Financial Responsibility Program via mail, e-mail, fax, or telephone, not in person at DMV

If the parents want to sell the car, they should pay the registration fees plus the penalty for not doing it on time.
Then put the car in either NON OP or NON USE. Neither one of these statuses require insurance. But you can't put the car on the road. You (or his parents rather) can still sell the car in that status. The buyer can't test drive on public road.

How is the car title? does is say daughter AND parents? or Daughter OR parents? If it says AND, then the parents need an additonal form REG 5. Which says when other owner died, where and who can sign for her. (By the way, I'm very sorry for your loss)

When the buyer goes to title it in their name, they won't have to pay for the registration, as it's been brought current. (they'll get a title, registrstion. They get tags when THEY show Proof of Ins.)

The smog certificate you have is good only for 90 days. After that you need to get it smogged again.

He can plate the car even without a license ;just cannot drive it.I would not get involved at all.More than likely he will drive the car.Anyone can Title a car in their name..anyone.There is no reason for anyone else to get involved.

I did stuff like that and ended up with a revoked license... 6 months in jail,,2000 dollar fine...3000 lawyer fee. and 4 months of driver school...
