My bros car was totaled and the car station whatever people won't release it can they do that?

We called the car people and they told us they won't realese it. we have to pay them for every day they have it, but they won't give it back

it was totaled, the next day he went to get it and they told him he needed all this stuff, he showed it to them and they still wouldn't release it, we called the insurance people and even they can't get it out. the thing is, this particular car station whatever has a reputation for NOT releasing the cars, thus, they get paid more. can they do that?

Then pay them...seems pretty simple to me. If you haven't paid them then why would they give you the car? Until you pay them they can keep the car....unless they sell it, which they can legally do.

Are they saying they won't release it until you pay for the storage fees up until now? It's hard to say why they won't release it without more information. If it was there for a while it's not uncommon for the facility to lay claim to the vehicle if the storage racked up is so high that it's more than what the car is worth and you've abandoned it.

Do you have an insurance claim filed? If so, have you explained this to your adjuster who is evaluating the vehicle damage?

If the car had full coverage and was totaled it belongs to the insurance company and they should pay the storage fees. If no insurance and it is part of an investagation by police they will hold on to it untill the investagation is complete. Other than that the car should be released with proper id and proof of ownership, if you are able to tow the vehicle safely.

What are you leaving out? Obviously if it's your brother's car, only he can pick it up, not you. Did the police put a hold of some kind on the vehicle? If so, the impound lot would have told you that. Yes, we can hold vehicles when ordered to do so by the police. I often have various holds that can only be released by the agency that put the hold on in the first place, or a vehicle where the plates must be brought up to date to be released, or those where insurance must be brought current before release. You need to ask what conditions would be needed for release. I'm sure they would be happy to tell you.

Two different things may be at play here.

1. The car was impounded by the police. If it's being held for evidence, you can't have it back until they're done processing it. If the car carries collision, the insurance co will pay all necessary storage fees to release the vehicle once the police are done with it.
2. Did he leave it there for a long time? Often when a car is a total, the person has no place to keep a wrecked car and leaves it at the tow yard while they figure out what to do with it. The registered owner has the obligation to "mitigate his damages." What this means is he needs to understand there are fees accruing every day the car sits there, and he's responsible to pay for them.

If there is no insurance involved, the registered owner has to pay for all the fees. If there is insurance involved and there is collision on his policy, they will pay for any necessary fees. If he let the car sit there awhile so he could figure out where to put it, they don't have to pay for those days.

i've seen tow lots like this that may charge 75.00 and more per day. Its a real rip off to say the least. Did your brother authorize them to tow and store it. If he did read, the agreement. Did he sign it? Did it say what they would charge? If this is in a city, call them as they sometimes have control over how much they can charge. I'm assuming you didnt have collision, because they would be able to get it out of there.
