My car was hit and I... don't have Insurance?

If the other party is at fault - they are responsible for your bills to fix your car regardless of your insurance status.

The real wild card with these situations is that sometimes - based on the repair cost and remaining value of the car - the insurance company will not pay you off unless the car is scrapped & you hand over the title. I think the rule of thumb costs more than 80% of the book value of the car to fix, its scrap time.

If insurance is required by law and you don't have any, you may have to sue for damages because you are breaking the law by driving without insurance

from my experience most dealerships make you have proof of insurance before they let you leave the lot with the car.

looks like you might end up paying for your car repairs out of pocket.

Maybe not. If you're in a no-fault state, you're SOL. Even in at-fault states, some have "No Play, No Pay" laws that bar an uninsured motorist from recovering anything from the at-fault party. Some limit that to property damage only and others limit it to any and all damages.

Once her insurance company finds out that you're uninsured it's very likely that they'll drag their feet on any claim. That would force you to sue at your own expense to recover any damages. If you were insured, your insurance company would have handled that for you, however since you're uninsured there's nobody on your side to watch out for your rights.

One more reason why you should ALWAYS have insurance at all times.

Fault is regardless without you carrying an insurance. however, there is still a possibility of being given a citation for driving without insurance.

Technically, she was at fault since she caused the impact, but you could find yourself in some trouble if the police want to know why you were driving without insurance.

You are going to get insurance now, aren't you? Say "yes", make those of us who already have insurance feel better about drivers like you who drive without it, thereby increasing the chances that our insurance rates will go up. Then go get some, for goodness sake, before you find yourself in a situation where you really wish you had it.

The law is not on your side, but don't worry, all of your car's demage will be fixed by the other driver's insurance, soon, I been there.......but do get coverage ASAP!!

Dear Lady,
Did you get a police report? That is very important although you were on private property call a police officer to come and just make a report..usually they cannot give a ticket when it is on private property.
if you were in a parking lot,normally it is private property and really there is nothing that you can do,other than be sure and get her insurance company name and phone number and address,you get hold of her insurance company ASAP and keep on them till you are satisfied.

more than likely you did not get a ticket for no insurance, but however if the officer sees you off that parking lot and remembers you had no insurance(and he probley will) he can stop you and give you a ticket for no inisurance....GET THAT INSURANCE HUNNY YOU NEED IT EVEN IF YOU JUST GET LIABILITY! that's the lowest you can get and the cheapest....good luck

Yes, they will pay. You need to get insurance ASAP to show that you are responsible. It may take awhile for them, you need to stay on them.
