My car was hit and totaled. I have no insurance. But I have a witness. Can I do anything?

you may or may not get the insurance of the other guy to pay for it but dont give up on trying but you can file it as a loss on your taxes as an unreimbersed personal loss or theft it has to be worth more than 7% OF YOUR ADJUSTED GROSS INCOME IN ORDER TO GET YOU ANY MONEY BACK ON YOUR TAXES

report it to the police, get a written signed document from that wittness, and if possable see what a lawyer can do to help you.

From now, to it's end, document and make copys of every thing mailed or handed to you. this is going to be a mess.

first you was in the wrong for haveing no insurance, you could sue, but like it go, most cases ,you lose, , i been their, years ago, it come down to me fixing the other man car,

I don't think you'll get anything. You are supposed to have insurance on anything! Especially if it is on public roads. Should have parked it in the drive or yard. We bought a car for our son that had to be fixed up. It took 6 months to finish fixing and him to get his license. We go fined at the license branch because we didn't have it put into our names within 30 days of purchasing. And found out then that we were supposed to have insurance on it too.

If the police were called and you have a witness you have a case. If your car was not being driven on a public roadway when it was hit your not having insurance, although a major screw up, does not matter. In 42 of the fifty states a hit and run is a felony. Get a lawyer, you have a case.

Ugh. Never drop one insurance company before picking up another--pick up the second company FIRST. So you may have two companies briefly.

Still, I don't see why this yo-yo should get away with destroying your car, regardless of whether or not it's insured.

Yes. Report the incident to the police. If you have the person's name, give it to the police. Give the name of the witness to the police. Besides damaging your vehicle, he is guilty of hit-and-run. Maybe the police will give him a citation.
Get a copy of the police report. File suit in small claims court if the dollar amount of your claim is within the limits of your claim. Present the police report and witness as your evidence.

You may not be hopeless... I thought insurance companies had a grace period of 45 days to cover you.

Ask about THAT and see if any Insurance Agents happen to read your question.

you should contact a good law firm [not dewy,cheetem,and howe] i assume the police have been called and a accident report filed and a statement taken from your witness?
the leagle system is slug slow, but if managed properly and kept after your claim will probably hold up in court.
