My car was parked on the curb in front of my house. I live in a condo so it has many parking spot like an apartment complex. There is an island that extends the length of one parking spot in front of my home; which is where I was parked on the curb. My neighbor across the street got into her car and backed right into the passenger side of the front bumper. She is now trying to argue that I am responsible for the damages to my own car because it was parked in a nonparking spot. As the former president of the homeowners association there are no established "NO parking" zones. My car was unoccupied since my husband and I were getting our two children ready to go out of town for the weekend. Should I be at fault or is she?

She is.
Your car was a hazard that was there to be seen.
There is no "but your car should not have been there for me to hit" defense.
If your car was improperly parked and that impeded her ability to get out....she had the right to get your car towed (at your expense)....She does not have the right to run your car over.
Just call her insurance company and report the claim. |

It doesn't matter where you were parked. The neighbor hit a vehicle that was parked. Her vehicle was moving, yours was not. She is at fault. |

If the spot is indeed a "no parking" spot. There is a good chance that it can be your fault. But if you are 100% sure that is a legal parking spot, then it is completely your neighbor's fault |

Signs or no signs you know if it's alright to park where you did or not. If you are not supposed to park there it's your fault. If it's a parking spot than it's her falut. |
