My car was totalled by an unisured driver, and I was injured. I was required to pay a $200 tow bill that night to tow the pieces of my car, and then I had to go to the emergency room for my injuries. I now have no car, a tow bill (which i couldn't afford), and medical bills....I need a car to go back to work, when I can....and I am a single mother...I need that money I spent on the tow to pay my rent..I dont have a penny to spare. I've been stuck at home with absolutely no help at all. We have few groceries in the house, and no money for food, either. I am going to lose my job and my home. My insurance can't help because I couldn't afford uninsured/underinsured motorist coverage....I can't afford another car, or my mounting medical bills. His insurance told me his policy had been cancelled and that I should contact the police. The police laughed and told me it was a civil matter, and they had no idea why I was calling them. I called an attorney, who told me that I could indeed take them to court, but I would have to pay the attorney fees upfront because if the person wasn't responsible enough to have insurance, they likely weren't responsible enough to pay me. "You can't get blood from a stone," he said to me. I obviously can't pay those fees....and even if the man did pay, which is unlikely, because he is unemployed, it could take years to get a penny. I was told to file a report with the BMV....but all they can do is suspend his license, and it already was suspended, AND that doesn't help me any...What can I do? Is there any help for me? or am I doomed to be homeless, jobless, and starving, and perhaps lose custody of my son...? PLEASE HELP ME

Try http://locate-power-of-attorney.info?432 say that you have no money to pay upfront, if any lawyers decide to offer to do the job you'll be at least getting the ball rolling.
There's a number of lawyers so you never know there might be someone with nothing to do.

Wow you are in a tight spot, I feel for you!
I would double check with your insurance company because the uninsured / underinsured coverage is normally mandatory under state law (depending on the state).
Another option is to call legal aide to assist you in a law suit against the other person. You may have a very hard time collecting but you will have some options ie. bank levy, lean on property and income withholding. At the very least its worth a shot! |

uninsured motorist only runs about $15-25 every six months. Your agent gave you very bad advice. In most states if you decline this you have to have signed a waiver saying you didn't want this coverage. If they can't produce this form, then they, by law have to honor the claim.
Contact your agent and ask them for a copy of the form where you declined the coverage if they can't and they refuse to assist, contact the state board of insurance as they are probably in violation. |

I don't want to sound hard here but it's YOUR responsibility to protect yourself and your son in the event of an accident, i.e; insurance coverage. The lawyer is correct -- the likelihood of getting a dime from this deadbeat is zero. I think it's time to plead your case to your local church for some help.

I am sorry that this has happened to you. Is there anyone you could ask to give you a ride to and from work so you can keep your job. I am afraid that taking them to civil court and hoping they pay is your only option. You can take them to small claims court without a lawyer. The award will be smaller cause their is a ceiling on how much you can sue in small claims court - but some is better than none.

You should have uninsured motor vehicle coverage on your insurance. Call your insurance agent. Other than this, I don't know what to tell you. |

Even if the person can't pay......Judge Judy pays you, (which I don't think is rightfully fair when the other party deserves to pay on TV the station takes care of all that)
