surely the fault is with you for not having your child under your control,its so easy to blame someone else for you own shortcomings.It is unrealistic to expect a child of that age to realise that it was dangerous thats what parental guidence is for . |

There are signs on the escalators warning about children on them. I expect they will use this to dispute your claim. Tesco haven't actually done anything wrong if you think about it, it was an accident not due to Tescos faulty machinery . Unless she tripped on some kind of wet floor or something in the way. |

Sure.. if she slipped on a wet floor and tripped, or something that wasn't her fault, sue away. But it doesn't sound as if they were at fault. |

It's not Tesco's fault your child tripped..it's YOURS for not ensuring your child didn't trip as she was not being adequately supervised as YOU let her run off towards the escalator.

So let me get this straight. You want to sue tesco because she fell over due to her own actions? Given the number of ambulance chasing, greedy c***s who call themselves solicitors then you probably could but maybe you should have been keeping better control of her instead of blaming someone else. |

If tesco's are seen to be negligent or the fitters or makers of the escalators are then yes. You would be claiming about either companies Public Liability Insurance but it would have to proven that they were negligent before you would receive anything

i should imagine that if ur daughter has done it then it is very possibly and likey that it could happen to somebody elses child that may not get off quite as likely.its obviously a massive safety hazard and would definately reccomend seeking legal advice.Even if just to ensure efforts arer made for the fault to be rectified! |
