My ex stole my car and was involved in an accident. my insurance company have refused to pay out because i wou

i refused to press charges .he did not have a licence or insurance,he did not cause the accident, the other driver was drunk.he done it on the spur of the moment.i felt he had been punished enough as the police are charging him

Sue the other driver in court for your damages. If you can prove they were at fault, they will have to pay for your car repairs.

Why would you be nice to someone with such an obvious lack of respect for you?

I have no simpathy i am affraid, after being hit by a hit and run driver, i got his reg but it is not registered. So i will end up having to fork out because of it.
Your ex should not have been on the road, and deserves all he gets, after all us law abiding tax payers have to pay for the likes of him

True the other driver is resposible, but if you don't want to press charges, then you can't complain. The insurance co. sees that your defending him. Hello!! you said he stole your car, and I'm sure he won't help you get a new one.

by not pressing charges, you are implicating yourself in this cime. Because you are letting him get away with stealing your car, it is telling the insurance company that you are fine with this person who has no liscence or insurance take your car......therefore you are breaching the terms of your contract with your insurers, and therfore (again) they don't have to pay you a penny. sorry.;

Unless you are willing to say .. Hey I was the victim of a theft. The Ins. Co. will assume your ex had your permission and raise your rates or worse refuse to renew your policy.

If you say he stole your car he will face charges for that too and you will avoid the messy insurance hassle. You as the victim and innocent party need to go after the other party as well.

To Save your ex you will probably find that even if the other driver is determined to be 100% at fault (blame is assessed by percentage) you will face repercussions in your Ins. Rates.

Well it's like this. He had no licence and insurance so therefore he should not have been driving. If he should not have been driving and obeyed that rule he would not have been where the accident took place. That said the accident would not have happened whether the other person was drunk or not. That's not excusing a drink drive situation.

Now you ask your insurance company to pay out and they refuse. Can't you understand why. HE WAS NOT INSURED. That potentially leads you to being prosecuted for permitting the use of your vehicle by a driver knowing that he was not able to drive by virtue of no licence and knowingly un-insured. I'm surprise the police have not charged you as I am sure you are not totally innocent in all this. (refused to press charges) I don't think so

Sorry honey you loose here. Your car and I hope the other driver sues for damage to his car

They will both get charged as they were both in breach of driving laws. You should be the only one who has access to the car as registered owner. In both instances they should pay the relevant price for their misteaks. As for the insurance company,they will always find a way to avoid a pay out. I call my insurance cover - A raffle ticket for the police. Get a new car and move on.

I would have pressed charges, now you are left with a broken car and he missed his chance to learn his lesson..
Fred is right, if someone is involved in an accident and he is not insured either he pays or whoever gave him the keys pay. But in the UK everything is possible and that's where you are right?
If so you are half safe as they can't lock up half the population.

Then why on earth have you refused to press charges??!!!!!!??? I mean DUH he was your EX and he STOLE your car whilst having no licence or insurance. Yes OK the other driver was drunk but 2 wrongs do not make a right.

Of course your insurance company won't pay you stupid woman - first off you are not pressing charges against someone who should not have been allowed to drive in the first place as he did not have a licence and no insurance.

Unless you have an "any driver" policy or your ex as a named driver on your policy, your insurers are within their rights not to pay. If he stole the car, then that is theft, but you might have to let the police press charges. If the other driver was at fault, you can still try claiming against the other parties insurers.

in that case your insurance company will consider you to have allowed an unqualified person to drive your car .this automatically invalidates your insurance so no payout. if you had reported the car as stolen or even taken without consent they would have had to pay. this is assuming that you had more than third party insurance.

My Boyfriend says If I get cught driving his car he will have to report I stole it or he will get 10 points and lose his license, You should report your ex, he will just get a bit bigger fine and you could pay it for him and still be better off. I suppose it is different for straight people but My boyfriend bought me a Ford Fiesta when i was 15 but says dont get stopped or he will wash his hands of me
