If she owns the car she can do whatever she want with the car and money. If there is a lien holder the check will be in two names and the car will have to be repaired unless the lien holder agrees differently.

If the car is paid for or if it is totaled she does not have to... but if it is leased or has a lien from a bank loan co. or dealer she does.....

no--she can just leave the car messed up and do whatever she wants with the money.... The money is from the other persons insurance----so who cares? Once they pay you off they could careless... A few years ago a girl rearended me and put a tiny crack in my bumper that you couldn't even see. Her insurance company gave me 700.00 for a new bumper... I left the crack and went shopping!

It depends on if you want it fixed or not!

no, they are just released of all responsibility. they won't investigate what you did what the money. i know plenty of people that didn't fix the car. or she can try to get it fixed cheap somewhere and keep the change ;)

no she does not have to fix it. The car is hers, the money is hers to do with it what she wants.

It is NOT insurance fraud.

Also to Amber's comment on the medical payments for $2500 this is NOT automatic. you do not get a 2500 bonus for being in an accident.

Well she doesn't have to but I think if she does not it would be the definition of insurance fraud!

she should, but the money is hers when it is given to her to do with what she wants. dont forget about med pay as well, thats another 2500 bucks the insurance companies forget to let you know about and by law, your automatically intitled to when you get into a wreck.
