She got in a little fender bender (even though her car has quite a bit of damage) but no one was hurt. she had a friend in the car but wasnt supposed to and the friend left and the cop got the friend's cell number and social security number. My friend told the insurance co that she didnt have anyone in the car and is planning on telling everyone that her friend just witnessed it, and recognised her and came to make sure she was alright but thought she had to stay because she just witnessed it. My friend got a failure to yeild ticket and is going to the judge on monday. They dont have proof that she had someone in the car do they? Just the other guy who was involved's word, so what will happen when the other guy and my friend's stories dont quite match up? Will my friend be able to pull it off as a misunderstanding? Whats going to happen? Please answer and provide details! Thanks! Additional Details And my friend is allowed to have one person in the vehicle but she just doesnt want her parents to find out. Her parents dont think anyone was in the car and she wasnt supposed to have anyone in the car under their rules, not the law's.

your friend could be facing a huge fine and possibly criminal charges for lieing to the police. she'll probably only get a fine and community service, but she'll have a police report if they decide to file the charges.
lieing to the police is a serious offense... and her story is kind of lame. they probably will believe the other driver. he has nothing to lose or gain from telling them the person was in the car, while 'your friend' has everything to lose from it.
When her insurance finds out, she's going to be in BIG trouble from them... they may not pay for the accident because she lied about it, and she may get dropped from her policy. she'll have to get insurance from someplace else, which will be really expensive because she was recently dropped and had an accident plus a ticket.
this doesn't include any punishment bestowed on her by the parents...... yeah she's in HUGE trouble if the cops find out, which they probably will.

stop lying and face what you deserve,you know there wasnt supposed to be anybody else in the car but you did it anyways,---think of it this way what if it turned out to be a bad accident and you killed your friend,how would you feel then------------learn by your mistakes. |

as long as your friend's friend wasnt the driver at the time of the accident the insurance companies don't care. and neither does the cop. you're fine. to both the cop and the insurance companies,,
your friend's parents on the other hand,, thats a whole new ball game. :) |

It's one word againts the other, but in this particular situation I think they will believe the other dude. Think about it: Her friend just happen to randomly be in the area of the crash and was so close so fast, and then all the other dude has to say is he seen her in the car before the crash. Im also assuming that your friend (driver) has a provisional license. Understand where I'm going? With my experience in the system this is the logic I came up with. |

The driving without another person for 6 months after you get your license rule is something they DO tell you not to do, but if pulled over for something minor and that is the case, cops will USUALLY not enforce this rule, you may have been giving them a ride and their just a friend,( not a co-worker or a parent or legal gaurdian, which in this case its ok to do it) but cops will usually understand and will let that go. Your friends friend should have just stayed in in the car, explained you were aware not to have any, apologize, and thats would have taken care of that. |
