Her car is in my name & her license is suspended...What leagal action will be taken against me?

No legal action will be taken against you, unless you get a subpoena to go to traffic court and they might question you as to whether or not you knew she was driving with a suspended license. If they vehicle was impounded you will have to pay to get it out of course. |

that depends on the cop. if they want they can charge you with enabling. the fine is about the same as driving without a license. |

If it's "Her car", why is it in your name? Did you allow her to do that to get around some point of law that didn't allow her to drive perhaps? Sorry, but the answers you are getting are not correct for the most part--those telling you that nothing will happen to you. Indeed something WILL happen to you. Since the vehicle is in your name, you are responsible for the safe operation and legality of the vehicle. If it is involved in a crime, you are responsible. If it has a serious accident, and there in no insurance, or not enough insurance, you are responsible. If it gets towed for any reason, only you as the registered owner can pick it up. And you are responsible for the bill for towing and storage. Since you 'allowed' her to drive, you can indeed be in trouble. They will not ask you "Are you aware she didn't have a license?" because they don't care. As with everything else, "ignorance of the law is not a valid excuse."
How do I know this? 32 years of law enforcement, state of CA, now retired. I now own and operate a tow service.
If by chance nothing happens to you (and sometimes you get lucky), or even if it does...get her vehicle out of your name!
Added: Let me add this. The advice to file theft charges are completely worthless. If it's not reported as stolen before the event, reporting it after is only a way to avoid responsibility for whatever happened, and everyone knows that. Do it and you could be charged with filing a false report. |

If you admit that you were aware that her licence was suspended and you still allowed her to drive your car, then you will be charged for 'abetting her' to break the traffic laws. Sorry hon, but that's the law! |

You will probably have to file "theft" charges against her to avoid prosecution. Otherwise you probably will be charged with allowing an unlicensed operator to drive your vehicle. That has implications in that your insurance company will drop you like a hot cake and you will be hard pressed to find other insurance coverage----and if you do the cost will be prohibitive!
It happened to my son with a friend of his taking the car and having an accident. The only option my son had to save face was having his friend arrested. Sounds horrible but you shouldn't have to sacrifice for others mistakes. |
