My friend wrecked my car, will my insurance cover me? help!!!?

My friend drove my car, he was getting pulled over and decided to take off! He hit two cars, totalled mine and demolished a bustop! I think his DL might be suspended. I have the maximum full coverage ins. with The General (CA) and they've been "investigating" my claim for a month, I dont know what to do! Are him having a suspended vs. valid DL, me giving him permission vs. no permission, or him not being named on my application/policy (he doesnt live at my household) factors that would determine my ins. covering all damages or not? Or since it wasnt me driving would it be legal for them to cover only the minimum state liability? I dont know what to do and my ins. is avoiding me, i know there gonna try anything not to pay! I need my car! :( Help!

You may have to file suit against your insurance company.
I would consider retaining an attorney. There will be claims for the damages to the bus stop. You cannot rely on your insurance to always protect you

your insurance is likely to not pay you anything. You gave permission to an unliscened driver who foolishly led a high speed chase with cops and damaged property.

YOU can be held liable for the damage he caused.

Most insurance companies will not pay if the driver of the car was breaking the law, as you say your friend was doing. If you did not give him permission to drive your car, did you report it stolen before the incident? If you did not report the car missing, then the ins. co. will assume you gave permission and probably will not pay for the damages.

Your insurance is not avoiding you, they are completing a coverage and liability investigation, and this can take time. Usually, a denial of coverage needs a full formal report which needs approval from a Home Office Examiner. It is not something which is accomplished overnight. Believe it or not, the insurance company is looking to cover you, not to deny coverage.

If you gave your boyfriend permission to use your vehicle, and he is not a regular user, then he and you should be covered. However, there may be an exclusion in your policy which refers to denying collision coverage when the driver is evading the police.

If you gave him permission to use the vehicle, you are going to be responsible for all of the property damage since you were the owner of the vehicle. It is possible your insurer will cutback your liability limits, but it is unlikely. Sounds as if he caused a lot of damage, and the damage may exceed your policy limits. If he has auto coverage of his own, he should report the loss to his insurance company. His liability coverage will kick in as " excess primary".

If he took the vehicle without permission and you did not report it stolen, your liability coverage may also be cut back to CA's compulsory limits too.

If you dispute your insurance company's decision, read your policy and find out if you have an arbitration clause. You may also have to consult an attorney.

You need better class of "friends" and a lawyer, suspended or an impaired driver voids any insurance coverage in most jurisdictions, the vehicle owner is 100% liable for any damages caused, that means the 2 cars, your car and the bus shelter.

I am surprised your insurance company has taken this long to tell that they are not going to cover it. Even if you gave your friend permission to drive your car, if he had no license and you knew it, you used your car to commit a crime. Anything that happened afterward just added to the mistake and were all additional crimes. In the eyes of the insurance company, a vehicle wrecked during the commission of a crime that you had full knowledge of...meaning the car wasn't stolen from you prior to him running from the police, then you are liable. They see it the same as if you were driving and wrecked your car while running from the police. You are liable. BTW, the General is usually for folks that have trouble getting insurance from the major carriers. Therefore your policy is probably in danger of being canceled too.

You're boyfriend wrecking your car should be covered under "Uninsured Motorist"... But with his license being suspended, all that is out the window... They won't pay anything, and won't get your car fix, simply because his driving privileges have been suspended... Plus, they have to pay for the other two cars' repairs also, if they're not already fighting them too... They may drop you... You'd have been better off reporting it stolen... Sorry to say you're up sh!t's creek... They probably just don't have the balls to tell you... And besides, you are with a BS insurance company anyway... You're mainly paying for coverage, not service... Progressive would've given you an answer the same day, if not, week...

They are just making sure they have everything covered when they DENY your claim. I would bet paychecks that your policy states Licensed drivers are covered, they aren't going to cover your hoodlum friend.

You will be out of your car and stuck with the others damages plus the busstop.

If somebody got hurt expect to be sued.
