Sorry, you can't sue for the death of your girlfriend's husband.
This gets complicated:
Your girlfriend can't recover from anyone for her husband's death because his death was his fault. BUT: check to see what insurance her husband had.
The family (parents/children) of your girlfriend's husband's girlfriend can sue your girlfriend's husband (i.e., his estate and his insurer) for their loss.

I don't understand why would anyone want to do that? Life is full of a lot of problems, none is as bad as an unexpected death, it will rip the soul out of the families. Most can't imagine the sorrow and grief that result. What would be the end result even if one could sue? |

If he has insurance, it will pay up to the policy limits. Lawsuits shouldn't be necessary unless the damage claim is for more than the policy limits and he has significant resources that could be attached to satisfy the judgement.
Sounds like a messy situation. Sorry your friend has to be put through this. |

Duh! You can't sue yourself. The only person entitled to a settlement for injury or in this case death is the family of the passenger who died. A negligent driver cannot recover damages against his own liability coverage for anything. That's not what insurance is for.
Suits are not brought against insurance companies for losses of this kind. You would have to sue the negligent person (in this case the dead driver) and that just won't work. The only time you can sue an insurance company is in a situation that does not match up with this one (not even going to put the idea in your head). Give it up. Unfortunately, you can try anything with regard to litigation, but it doesn't mean you'll succeed. |

The answers given by "Lizc" and "Joyceela" are basically correct. If your friends husband was the sole registered owner of the car there would be no insurance liability because you cannot financially enrich your self through your own negligence.
If your friend was a co-registered owner of the car (she) could claim against the loss of the car , but the auto policy would not pay on the death of her husband. If he had life insurance she could claim on that.
The heirs of the husbands girlfriend would have a valid action against the registered owner of the car she died in for her death. The insurance company would only be acting as an agent on behalf of the owner of the car in any law suit. |
