My hand was badly injured in an accident that was not my fault, what should I do?

I snapped the middle and ring finger metacarpal in the top of my hand which required 2 surgeries and 4 screws in the top of my hand. I am in therapy now but do not expect to regain full range of motion. My hand will not close or open all the way. I am very active ex. golf,fishing,softball, etc.... The other gentleman ran a stop sign and I hit him in the side at 55 mph ( never had a chance to hit the brakes before we hit).

The other gentleman was killed in the wreck which haunts me everyday. I'm not sure which direction to go. His insurance company is paying for my medical bills and lost wages. He said we would discuss pain and suffering later, but we have not talked about the possibility of my "loss of use" in my hand yet.

What should I do and what should I expect?

The other insurance company will do nothing until your medical treatment is finished. When it is finished they will more than likely offer you a settlement. Only you can determine if that offer will be enough to satisfy you and your future needs. Because it sounds as if you may have permanent disabling injuries, I would think about hiring a lawyer. Remember though, the lawyer will take 1/3 + expenses of anything he may be able to get for you and the case may drag on for years with a lawyer

Discuss usage loss with your Dr talk to your ins company on advice, they have lawyers to help you figure this out, sorry .

Sue them for sure. Lawyers are crawling out of the woodwork for that kind of open and shut case. You need to estimate what the value of your loss is for the rest of your lifetime and sue them for that.

Deal with his insurance, but make sure you get an attorney. If you don't have an attorney, you will absolutely not get the amount of money you deserve.

Also, if you don't agree to a settlement before the statute of limitations expires, you lose the right to collect. If you have an attorney, the attorney can file a motion that would delay the statute from expiring while you work on your health and negotiate with the insurance company.

I'm sorry for the accident and the loss of life. I can only imagine how difficult it must be. However, it is the insurance company that will be paying, not the deceased.

Well first off, it's not your fault he died. Secondly, I would just leave it how it is because he died and it's not right to sue his family for the stupid thing he did. You can contact the insurance company to pay you what you lost in wages and if they refuse get a lawyer.

First of all I'm sorry to hear about your loss. You can expect this to take a while to settle. Probably a year or so from the date of loss. Which i know sounds like an eternity but this type of an injury will probably not have a final dispostion for a year. And what you have left is what you have left. You do not need to get an attorney necessarily. An insurance company has an obligation to make a fair settlement. An attorney doe not necessarily get you more money. They just take more from you. On average 30-40% and this is before ANY medical bill is paid which means you could end up with the short end of the stick.

You sound like a bright person, I think you could handle this on your own just don't be in a hurry. Let you hand heal. This is going to take some time. Once this is done contact the insurance company and see what the offer is.
