Hi there, we live in Ontario and my husband was making a left hand turn onto our side road to come home. Apparently his signal light wasn't working. A vehicle came from behind him and passed on left, and hit front of his truck just as he was making turn. He was charged with no insurance and unsafe vehicle. The police report says that reason for accident was failure to yield. The other driver was not charged. Insurance company tells me that we are liable for 50% payment because his lights didn't work so he put the other driver in an emergency situation because of unknown intentions. The highway he was driving on has at least a mile clear view in both directions and across from the turn on the right shoulder is one of those wide passing lanes.
The adjuster I was talking to said that the insurance act only applies when both vehicles have insurance. I thought that rule 6(3) of the regulation applied but she says 10(6) applies and something about tort.
I can't find any information about rules for no insurance. Any information you can give me would be great.
P.S I have told my husband he was not smart for driving with no insurance. He has learnt his very expensive lesson.
