My mom was in a car accident, she was driving my truck?

I had lend my truck to my mom and a guy crashed into my truck. It was the kids fault cause my mom was waiting on the red light when she saw the car coming straight at her she had no where to move to since there was cars besides her and in front of her. I have insurance but my mom is not covered on my insurance. My mom talked to the guys parents and they don't have insurance so my mom told them that they needed to help her pay for the damages and they refused. They don't want to pay at all so my question is can I take them to court.

Just wanted to add that my mom called the police and a police report was made. The guy told the cop that it was his fault and not my moms.

If you gave your Mom permission to drive your insured vehicle and she has a valid drivers license, your insurance (with rare exceptions) will cover her. So if you have collision coverage and turn this into your insurance company, they will pay for repairs after you pay them any collision deductible you may have. When your insurance company pays out on your behalf, they will go after the other driver and when/if they collect, your deductible will be returned to you. So if this all applies, your insurance companies actions will work for you so you will not have to sue them.

Definitely talk to your own car insurance company to figure out your options. They should be very helpful to you. I hope you got the name and phone number of the guy responsible.

and I would go to the police and tell them so they can make a report and then get some estimate ( 3 ) and send them to the other party and file to sue them in court

I hope you called the police. Did you talk to you insurance yet, because they should be responsible for the damage. You might have to get a lawyer.

Sure you can, and if your mom is specifically not covered under your policy, you'll HAVE to.

Likely, it will take four to six months to get them to court, and even if you get a judgement against them, it's very possible that you'll never be able to collect a dime against them.

you can but it depends on the value of the truck if it would be worth it at all. If it is brand new, it might be worth the court costs. Unfortunately, because your mother is not covered by your insurance there is not a lot you can do other than legal action (your word vs theres)
but again, please remember they don't have insurance or money, so you can take them to court but i wouldnt hold your breath on them actually paying.

just take it as a lesson learned, and do not let someone drive your car if they arent on the insurance. period
