My mother gave my brother a car but he has no license. What can happen to my mother if he gets into an acciden?

More important is not that he doesn't have a license but that he doesn't have insurance. Yes both your Mother and your Brother can be sued. To those here that say the Mother cannot be sued, let me remind you that anyone can be sued by anyone for anything at anytime.

Nothing will happen to your mother..... Your brother will be fined and possibly jailed. If anything, he could have taken the car without your mom's permission...

She can be sued if he is underage. She can lose everything she has or will ever have.

Your brother should not without a license and insurance. He would be in serious trouble if he got into an accident, especially one involving personal injury.

You did not say what state you are from or where your mom or brother are from. In many states, even if you do not have al license, you can title and register a vehicle. If something happens, like an accident, ticket or violation, it will all go back to your mom because she is the legal owner of the vehicle. Check with your local DMV and see if your brother can title and register the vehicle in his name without having a license. If he can, make sure you mom signs the title over to your brother, sign and date the title, and more importantly, make a copy of the title front and back proving that she gave him the vehicle. If your state requires she turn in her plates, do it immediately and get a receipt, further proving she has no responsibility to the vehicle. And of course she should cancel any insurance she has on the vehicle. If your brother can't or doesn't title register and insure the vehicle, then your mom has documentation that she has given the car to him and is basically not responsible for it. She can get sued, but if she has proper documentation (ins cancellation, plate turn in, copy of the signed title) it will help her.

Legally nothing, she can give the car to whoever she wants. Common sense says she should stress that he is not to use the car until he has his license. If he drives it without license then that is up to him. If your brother has no license then he is probably to young to be held responsible.

put it like this if your mum gave your brother some money for his birthday and he went shopping and bought a gun then shot someone and killed them would your mother be had up for murder no she would not so it is the same with the car what ever he does with the car is his problem not your mothers
