My niece was killed in a car wreck last night. Is the guy that was driving insurance responsible for paying?

for the funeral services.

No I'm only concerned about how the services are going to be paid for since the family has no money.

Liability has to be determined before any payments will come from the at fault party.
But, have your sibling look at their policy, they may have medical payments or PIP coverage, both of which normally include funeral expense coverage. When the accident is reported to your sibling's insurance company (this needs to be done immediately), they should be able to find out if they have medical payments coverage & how much they have for funeral expense.
So sorry for your loss.

Normally no... Auto liability insurance pays something towards medical expenses, but does not pay for funerals.

I'm sorry for your loss. My answer is what I know about my state... I'm in Texas. It depends on some details of the accident. If your niece was a passenger of a vehicle that has no-fault first party injury coverage (PIP or Med Pay) this should cover some funeral expenses and there may be an additional death benefit if she was wearing a seatbelt or had airbag deployment. If the other driver was at fault, there may be potential for a bodily injury claim against their policy -or- if she was a passenger in a vehicle and the driver is at fault, she can file a bodily injury claim against the vehicle's policy. Call the insurance carrier and file a claim.

I'm very sorry to hear about your niece.

It depends on who is at fault in the accident and the type of coverage. If it was the other driver's fault and he/she had liability insurance (which most people have) then yes, they are responsible up to the maximum amount that the driver was insured. If the driver didn't have insurance, the family can sue.

If your Niece was at fault, then her insurance would be responsible to pay IF she was insured for medical costs. Not all insurance policies include medical costs (at least in my state).

More than likely the owner of the cars ins. will be responsible for funeral cost. but her family will have to talk to the funeral home first to let them know. the ins, company will settle with the family and this should cover the cost.

Im soooo sorry about that.
My nephew had a wreck In october, he died twice in the helicopter, but they revived him. Oh my gosh, I AM SO SORRY, that is terrible.

if it was a complete freak accident... no. If they were drinking or racing yes. But if she was playing in the road, or their was a defect in the car, or the weather was bad, or it was dark and she didnt have reflexives on then no.

But the public goes nuts when a little white girl gets killed, you will have donations.

the driver probably didnt do it on purpose and probably feels like the most horrible person.

How would you feel if you accidentally killed a child? put yourself in his shoes. would you want people on your a$s screaming at you to pay them for what you did? no! for the rest of his life he will have this on his conscious. if he is a decent person that has any money to spare he will probably help with the costs willingly as best as he can.

sorry about your loss, but you need to chill.
