The lemon laws cover NEW vehicles, sold by dealers. If your son bought the car from a private party, it is assumed to be as-is, unless the seller gave him a written warranty stating otherwise. If he bought it from a dealer, there should have been a warranty sticker on the window, stating what, if any warranty was included.

It sounds like your son is going to have to pay for the repairs.

I am assuming that your son is over the legal age of majority (18 in most states). If he is a minor, he can not legally contract for other than necessities (food clothing and shelter) and can disavow the sales contact and get his money back. In a case like this, you may need to hire a lawyer.

Private sale in most states is buyer beware. Unless some frauds in paperwork- hard lesson learned.

Private sells are final. Before your son paid for the car, he should have responsibly taken it to a mechanic for a look over. When you buy a used car from a dealership, then you can fall back on what's called a "lemon law" usually 10 days if something seriously wrong with the car you can return it to the dealership - but private sell's are Buyer Beware.

Unless there is something in writing from the previous owner stating "I John Doe, guarantee this car has no mechanical issues....bla bla bla" there is nothing you can do.

Its a "live and learn" lesson for your son. He bought a car from a private seller - did not take it to a mechanic before purchasing - and he got burned. He wont make that mistake again...

Unfortunately, no. if there was no implied warranty, you can't do anything about it. You could try taking him to court, but I don't think you'd win.

It also depends upon the state you're in. His statement "The car's in great condition." is just your word against his. ".... great condition for its age."

The court will probably tell you that you should have taken it to your mechanic before you paid the money. But you already know that.

If the car is not registered in your son's name yet, take it back, put a brick on the accelerator, start it up and return it to his front door.

Lemon Law only applies to new cars (or cars that have never been titled to a private owner).

What kind of papers did you sign? You could take him to small claims court for the amount that your state allows. Get something written up by your mechanic to prove that you brought it in to be checked and there was something wrong with it and you will most likely win.
I would see if you can talk to the guy who sold it to you first. Be harsh! Act like you know all of the laws and make it seem like he is screwed no matter what and scare him. Tell him you will get a lawyer, etc. Give the car back and get your moeny back.
