The tree! Go give it a smack. Then hopefully you have insurance, so call them and report it. This is what your homeowners insurance is for. |

Report the loss to your home owner's insurance. If the tree was healthy, you are not legally liable for the damage to the vehicle. Your neighbor needs to prove you were negligent. They need to establish you knew the tree was sick/dead/unhealthy, and failed to take the correct measures to remove the limb.
Your neighbor should report the loss to their auto insurer. The auto insurer will decide if you were negligent. |

If you are SURE the tree is on your property than your homeowners insurance will cover it.
OR you could tell him to forget about it or you will cut the rest of it down and let it fall on his house!!! |

Why did the tree branch fall?
If I am not mistaken, the responsibility will not be yours unless you knowingly did not care for a dead/rotten tree.
Also if it was due to heavy wind, rain, or snow it may be considered an act of god, really screwing things up for everybody. |

your neighbors auto policy should cover it ...i hope he has comp on his policy. if a tree from your yard fell and hit your neighbors house, it would also be on his insurance. |

Obviously the tree.
If it happens to belong to you and you haven't taught it not to throw bits of itself at the neighbours car then it's down to you.
Your household insurance should cover this unless your tree has taken out a policy. |
