Call the ins co, your car maybe covered for uninsured motorist damage or since it was on your property may covered under your homeowners. Make your agent earn his money. Some states have funding available for crime victims, look into that, since a criminal act destroyed your car. Don't just give up, you suffered a loss and deserve to be compensated. If all else fails, you can write it off on your taxes as an uninsured loss for the value of the car.

If the person whos toel the vehicle is under 18, it is his parents/guardians responsibility to pay for any and all damage. If the kid was old enough, the parent/guardian or even the judge can or may order him (if he recovers well enough) to get a job and pay you back in full for all damages.

YES, it is worth it to file a civil claims lawsuit, which coul easily win you back the cost of the damages. More than likely, they will have to make you payment arrangements, but it is much better than paying for it out of pocket.

Your insurance company should compensate her for the damages. Even if you don't have full coverage, you do have liablility. In your case, the bike that did it, was uninsured. If you have insurance, then you have an uninsured motorist policy available. File a claim with your own insurance company through the uninsured motorist department. Your insurance company will cover the damage deducting the deductible. After they close your claim, they will subrogate the money they layed out from the driver of the motorcycle, unless he has no assets. So call your insurance and open a claim. They can't deny you this. This is your right. They will ask you for proof that the bike had no insurance.

If you got anything at all, it would be limited to the worth of the vehicle at the time of loss, not repair costs or replacement value. Do you have coverage for uninsured motorists on your insurance policy? If yes, file a claim and get reimbursed for your loss. If you don't, you were essentially saying "I can afford to take a loss under the conditions the other person doesn't have insurance, or it's stolen or burns up, or if the loss is my fault."

Was your car parked? Report it to your insurance. If you don't have collision maybe uninsured motorist property damage will pay for it, if your state has that.
