she has raked up medical bills of 35,000 our health ins has paid alot less than that so we have 2 questions number 1 we have been told the only money we will pay is what our ins pays out so they have a agreement to pay the dr for the contracted amt for ex the knee is surgery was billed to ins at 18 000 and they paid 2600as the contracted amt. I want to make sure that we pay that amt and the adjust pays based on the larger amt. What would a good settlemt offer be? Thanks

The policy limits on the car at fault were 25,000 we just got a ck for that amt minus what the health ins company has paid. So to date we netted 22000 we are going after the underisured motorist coverage on the car she was riding in not sure the limit 200,000 i think but on top of that there is a umbrella bal with 2 mill. I know were not going to be able to retire just curious after 35000 worth of bills what is this worth in pain and suffering? Any help would be great.

I am in the same situation. My husband and I were in a serious accident. Our insurance pays for all of his surgery and medical bills, but we are responsible for the copay or percentage left after the contracted amount. All of our drs still charge us the remainder.
My attorney is getting us money for medical bills, pain and suffering and lost wages.
My attorney also said we have to pay back any amount the insurance pays for injuries resulting from the surgery. The insurance will put a lien on your settlement for the whole amount.
If the accident was someone elses fault, then their insurance should be paying her medical bills and lost wages if their was any. The only reason why her insurance isn't paying everything in our case is because she only had $50,000 coverage. We won that amount in that settlement, but can't touch it until our other lawsuit is settled with our insurance for underinsured.
Just remember, if you settle and then there is more medical payments or treatments, you will not be able to get that money recovered.
I hired an attorney because my husband has $68,000 in medical bills and has not been able to work for 2 years now.

OK, you do NOT get reimbursed for $18,000 in medical bills, when the ACTUAL amount paid was $2600. The medical records WILL go to the insurance company, along with the billing.
YOUR HEALTH insurance company, that paid the bills, THEY get first dibs on any "settlement" money.
Any settlement is going to depend on the extent of the injuries, who was at fault, which insurance company is paying, AND, your state laws. Not to mention the policy limits involved.
So, there's not enough info for a guess. |
