My wife was in an car accident, what are her options when it comes to insurance?

OK... about 3 weeks ago, my wife was rear ended and pushed into another car in a car accident. She has now a pretty serious case of whiplash... and a totaled out car.
The driver of the car that hit her was not licensed and claims he has insurance, but he was not driving HIS CAR, it was someone else's. The owner of the car he was driving has yet to be located, so because there was no proof of insurance in that vehicle it is unknown if the vehicle that rear ended my wife had insurance at all.
Since the driver of the car that hit my wife does have insurance, just not for that vehicle, will his insurance still pick it up? We have Allstate, and they have already totalled out my wife's car, giving us a whopping crappy $2,700...
Here's the problem's... 1. her car was a 2000 Dodge Neon and was in perfect condition for us, and never gave us any problems what's so ever. Basically for us the car was worth a lot more than $2,700 because it was reliable... now we will purchase another car with the $2,700 and really won't know what were getting in to; could be a lemon or could be a great car... 2. problem... my wife is injuried, she has had to go to the doctor now several times because of this already... but... we are not the kind of people to file a lawsuit... its just not our style, we know it was just an "accident"... so with all that information, what should we do from here on out?
For us, her car was, like I said, worth a lot more than just $2,700, we'd value it at $20,000 or great, just because it ran so good... I feel like we our owed something much great than $2,700 and Allstate paying for our medical cost's because of some jacktard that should not of been driving in the first place, and another jacktard loaning the car out in the first place to him... It's like were the victum's across the board here and we can't do anything about it, except continue to take it up the "rear end"...

First off, obviously you didn't read what I posted correctly... I said "TO US" the car was worth $20,000; not to Allstate or anyone else, just because the car did not give us any problems... I am NOT asking for 20K for the car... ignorance is bliss!

in Tennessee we would go after the driver of the vehicle if the owner of the vehicle has no insurance, if neither has ins. then it should fall on your uninsured motorist bodily injury and property damage on your policy if you have that cvg, if someone threatens to obtain a lawyer then our adjusters do not speak with that person any longer and it falls on the lawyers to do all the talking, some companies will give you a certain % extra for pain & suffering on top of paying your medical bills |

Unfortunately your insurance company, or any for that matter is only obligated to pay you the actual market value of your car. Not what it is worth to you. Get an attorney and sue the other driver. |

I wold file a lawsuit and keep at it till I get Justice. I would also keep track of that driver's address to pay a visit in case I get no justice.
But if you are not the type, then swallow it and move on. |

The property damage and any injury settlement are completely different issues. You are only paid the fair market value of your vehicle. This is NOT blue book or any other kind of value. They will take into consideration the overall condition of the vehilce to include, mileage, paint, interior, glass, tires, exterior, prior damage and all. THEN they will make an offer.
The issue of who's insurance company it is is complicated. Allstate is ONLY liable if the owner of the vehicle does not have insurance. This is called excess.
In a situation like this you are far better off filing under your own collision coverage and letting your insurance company FIND the CORRECT insuarnce company.
Hiring an attorney doesn't make this process any easier. It's not like an insurance company has a secret magic button that because they call all is better. I'm not saying you are saying this but many will say get an attorney. If you do not carry collision, you're going to have to sit back and wait for the investigation to be concluded. |

Allstate will likely NOT cover the loss. And that is abolutely their right. Insurance follows the VEHICLE not the driver. If he doesnt insure the vehicle why would they pay? They arent getting premiums for it.
I hope you were knowledgable enough to have uninsured motorist bodily injury coverage on your policy. In this case... if the guy doesnt have insurance on the vehicle you can collect under your policy. If not.. sorry. you can "sue" him but you cant get blood from a turnip. |
