Need help about insurance claim?

I live in Illinois and was in a car accident. The insurance company (very well known)is ready to settle, but I have a problem. I am on public aid which paid for my medical bills, but I want the settlement check to come to me. Will they issue me a check for the medical bills (not pain and suffering that's something else) and let me take care of the bills, or will they pay Illinois Dept of Public Aid directly? If they pay them directly how do I get around that, because I want them to pay me instead?

Usually the insurance company has a statutory obligation to re-imburse medicare, medicaid, tri-care. So, I expect that they have a statutory obligation to make sure Dept of Public Aid is protected.

I usually protect th is bill by making the check payable to the injured party and the dr office. That way -you endorse it and give it to the dr. The dr office will refund the government for it's payment.

You are living on the public dole and want to be paid for what you are already getting for free. Get serious. The money spent to care for you will go straight from the insurance to the state...as it should. You are just hoping for a little windfall. It isn't going to happen.

Theoractically, insurance check is to reimburse expenses that cost you. In this case, you can request the check go directly to you, unless the insurance company have proof that the bills has been taken care of by third party (meaning someone other than you already paid the bill). They may need you to sign and notarize a settlement form before sending a check out.

Sounds like you just want the money to yourself.

According to my attorney - pain & suffering & medical come together -

In a car accident (I was just in one in October) there are 2 parts to the claim
a) the vehicle damage / lost wages (including replacement of car /booster seats for kids + towing charges if your car is not in driveable condition)
b) pain & suffering & medical

If the bills have already been paid they will reimburse the state.

If you had an accident in which public aid was afforted you, you should pay. This would insure someone else can use the same service. If you don't have a clue about how the claims work, get a lawyer and let them cheat the system for you! They would be responsible for distribution of funds to all parties involved.
