i let my friend drive my car and didnt know my insuance lapsed until after she wrecked it. she agreed to pay for damages but later backed out a few weeks later i got back on myinsurance but i couldnt get the coverage, can i sue?

Well i didnt get a notice saying my insurance had lapsed because it just happened just days before i called my insurance co. and found out. My friend has OFFERED TO AGREED (it is in writtin document) to pay for what ever needs to be paid for, so i took her word, then all of a sudden she backed out. She totaled my car and the person she hit basically and showed no remorse for the other victim. I just thought that since she did sayshe would pay then she should. "and she never asked me if i had insurance before she got in my car"

As you let her drive it thinking she was insured then NO.
Your lucky she is not suing you.
Why should your Lapsed Insurance pay? I assume like every one else they sent you a reminder and renewal notice.??

Nope, it's your own fault for:
A) Letting your friend drive your car (in the uk unless she was a named driver she wouldn't have been covered anyways)
And
B) Not making sure you had adequate insurance in the first place. |

You let someone drive your uninsured vehicle. Although you claim you didn't know your insurance had lapsed, you should have known it was. You are responsible since it's your car.
Who do you want to sue? Your friend or the insurance company? You can't sue the insurance company because you didn't have coverage at the time of the accident and they aren't obligated to pay. |

Yes, of course you can sue them.
You are probably legally responsible for any property that she hit, but she is responsible for wrecking your car.
Find out how much damage there is to your car, get it fixed, then take her to small claims court. Getting her to pay is another story.
Edit: also, if you friend has insurance, or is on her parent's policy, it may be possible to place a claim through their policy, no guarantees here though, as all policies are written differently. |

You can sue your friend in small claims court for the damage to your car. Make sure you take a few estimates to court with you.
Your insurance company does not have to give you collision coverage if you car was prior damage. |
