No insurance, spun out on highway during severe snow storm and was hit. Who is at fault?

The section of highway I was driving on was 2 lanes wide and straight for a mile. Traffic traveling the opposite direction was separated by about 100 feet of grass. The maximum speed limit is 65mph and the minimum is 45mph. I was traveling at an estimated 45mph in the slow lane. The tail end of my car began to slide out to the right and I was unable to correct this due to the terrible conditions of the road. I spun completely around and was facing directly into traffic in the fast lane. A car traveling in the fast lane (at a rate of speed unknown to me) hit me head on, totaling both cars. Its hard to be sure, but I am estimating that the time between initial loss of control and impact was around 10 - 15 seconds. There were no injuries. I did not have insurance on my car due to being a college student and not having help from my parents. It is not legally necessary to possess insurance. Two months later, a collection agency is looking for $3,472 from me. Should I have to pay this?

If where you live it is REALLY not required to have insurance, I would think the only way you would have to pay for the damages is if you were "at fault" for the accident. You might contact the local authorities, or an insurance agent, possibly your department of motor vehicles and ask then in that hypothetical situation who would be at fault. If they say it would be a no fault accident then I believe you might have some ground to stand on.
Of course the other person's insurance company will go after you, they don't want to have to pay for it, so if you were really not in the wrong I say fight it, you being the one out of control though might make that accident your fault. Which if that is the case you'll have to pay.
You'll fare better, though, if you do your research first so you have a good idea of what you're up against. This place (yahoo answers) is good for idea's, but you'll want to get hard concrete facts from professionals to battle this collection agency. It probably can't hurt to talk to a lawyer, some might give a free consultation. Good luck!!

it would be your fault. and yes you will have to pay the money you owe them. you will probably have to pay for the damages to the other car too.

Yes, you should. It was the fact that your vehicle was out of control that caused the accident. You entered the other lane. You were facing the wrong way. So the accident was your fault, and you should pay.

Not legally necessary to carry insurance? Where do you live? Anyhoo, if you don't pay, it may go to civil court where you both tell your sides of the story. The police report will play a big part of it. It may be up to the judge.

Yes, you should. It was your fault, considering you spun out of control. Plus with no insurance, you are definitely at fault.

lol are u kidding me? YOU spun out, YOUR car was facing traffic, and YOU didn't have any insurace? insurance shouldn't be that expensive so take this as a lesson and go get some insurace, the next time this happens you won't be out a bunch of money.

Yes you are at fault for failing to maintain control of your vehicle and driving too fast for conditions. The other driver was in his lane and in control of his vehicle. You were not.

You owe for the damage.

You are lucky your drivers license was not suspended.

Call the collection company up and set up a payment plan.

Next time - don't drive with out insurance and be really lucky you did not kill anyone. You got off cheap at 3500.

It's all your fault.The minimum speed limit does not apply in bad weather. You were driving entirely to fast and did not have your vehicle under control. There is no excuse what so ever for having no insurance,if you can't afford the insurance you don't drive. It's that simple.Your lucky that your only being asked for $3,472. You have left your self open for a large lawsuit. Pay the money and consider yourself lucky. And either get insurance or get off the road. P.S. Learning how to drive would also be a good start,obviously you don't know how.

my conclusion:

pay the bill and you`ll be out of more troubles............penalties for not purchasing auto insurance vary by state, but often involve a substantial fine, license and/or registration suspension or revocation, as well as possible jail time in some states. Usually, the minimum required by law is third party insurance to protect third parties against the financial consequences of loss, damage or injury caused by a vehicle.

Clearly, God is at fault. He sent the snowstorm which caused you to spin out of control. Retain legal counsel and subpoena The Lord for damages.
