My fiance was just leaving for work about 30 minutes ago and hit a parked car parked on the side of the road. It busted out the taillight and since it was a company car the guy had to report it. We told the cops that I was driving, and on my registration it says I have insurance even though it has lapsed. This wreck was our fault and the cop had to take down both insurance policies. I was wondering if the other guys insurance company tries to take us to court to pay out of pocket if I could just tell them i'll pay them for the repairs without even getting attorney's involved. Or if I could call the insurance company and tell them that my insurance has lapsed and i'd be more than happy to pay them. I know I should have some kind of insurance but I can't afford it and we need a car living out in the middle of nowhere with a one year old. Additional Details My license also doesn't have the address that i'm living at since I don't have any bills to take with me to the BMV to get it changed (I already tried) and my registration has a different address on it than my license. The cop didn't say anything about it. My registration has a different county and address than the one i'm living at or the one on the license.

The only thing you might get in trouble for is driving without insurance. But the police probably have more important crimes to worry about that they probably won't come after you for that. Just get insurance ASAP. And the other driver's insurance will probably come after you for the money for the tail light, which I think they'll try to collect the money from you first before taking it to court. So just wait to hear from them and pay when they collect. |

You are in trouble. Once you get the cops involved, its up to them, period. "I have no idea what happened(to the owner of the work vehicle)" is always better than "I did it, my fault". Never admit guilt.
Well, maybe not in trouble, it depends on what state you live in. In VA (where I live) if you let your insurance lapse by 15-30 days, the insurance co has to let DMV know that you lapsed (assuming a car is registered to you) and your license gets suspended. Now if your husband to be doesn't own a car, he doesn't need insurance (in VA) because vehicles need to be insured, not individuals. |

If he was telling the truth, and it is a company car, they will have uninsured motorist coverage on it. Even if he was lying, if he has insurance on it, it will fall under uninsured motorist coverage. Either the company's insurance or his insurance will pay to have it repaired. If it's only a taillight I wouldn't think that it would be worth their time or expense to sue you for repayment. You could probably pick up a taillight, pretty cheap, and make it right with him. I would suggest doing that, it's the right thing to do. www.craigslist.org has good used parts cheap, or check your local junk yard? |

Yes, of course the no insurance wreck is your fault.
Here's the bottom line. The victim's insurance company doesn't care who was driving your car. And the police probably have other important business to take care of. It was definitely irresponsible for your and your fiance to be operating a car without insurance, and to have lied about who was at fault for this accident.
But, the insurance company just wants to know that it's going to be paid back. You need to talk to the victim's insurance company and let them know that you will reimburse them for the damages to the other person's car. They will put you in touch with their subrogation department (collections), and they will put you on a payment plan.
If you attempt to default or skip on payments, they will pursue you with credit collectors and seek repayment to the full extent of the law. You may find that they are very reasonable about getting their money back, but don't expect them to just consider it a loss.
When you read this, please go purchase some minimum liability insurance so that you don't have to go fishing for answers on the internet after getting into trouble. |

I hate to tell you, but once the police put all of this together, you are going to be looking at possible criminal charges against both you and your husband.
You lied to the police & said you were driving (filing a false police report), your insurance is lapsed (driving without mandatory insurance), failure to change addresses on your license & registration within the 30 days required by law.
If this blows up in your face like it very well could, I hope the bus runs out by your house, because you may just be looking at needing to memorize the public bus schedules or taxi company phone numbers for quite some time. Because the police will press charges & the DMV will be asked to suspend/revoke yours and your husbands licenses. And it doesn't matter what state you are in, the penalties can include jail time. You said you had a small child- if you and your husband both end up in county jail for a few days, weeks, months- you are going to lose your child. You do know that don't you?
So you had better hope the cops investigating & the other person's insurance company employees are about as bright as a burned out light bulb & not the intelligent, well trained police officers I work with. |
