No mot on car. uk. what penalty ?

my daughter has just told me her mot has run out. I said I will help her with it this weekend and not to use it. she wants to continue driving it and I said it is not a good idea but I can't stop her as she lives 100 miles away. what will happen if she gets caught by police for using it ? I live in uk.

If you have have a car with no MoT, you can only legally drive it to a pre-booked MoT test appointment.

There is a greater chance than ever before of being caught for driving illegally.

There are now cameras that automatically read number plates and alert police of certain discrepancies such as no MoT, no insurance, no tax, and other matters in relation to the registration number.

No MoT alone is not considered a serious crime but if she is stopped for no MoT the police may do a vehicle examination.

Depending on what is found they may than condemn the car from further use until a new MoT is obtained and proof of this is supplied to a police station. This will mean the car will not be allowed to be driven and will have to be transported off the road at expense of the owner/keeper (PG9).

If faults are found on the car there may be additional charges.

If you allow someone to commit a crime you can be charged with aiding and abetting.

she'll get a fine which can be around £150.00, but no points etc will be given.

Driving a car without an MOT certificate carries a maximum penalty of £1000. She should not drive the car until she gets another MOT certificate. £1000 is alot more than the (approx) £50 for an MOT certificate.

The test is a legal requirement for cars aged over three years and driving without a valid MOT certificate carries a maximum fine of £1,000 and possible disqualification.

Just ask her to think about how bad she would feel IF she did have an accident because something was wrong with her car and she killed someone. Also if that did happen she would be in a lot of trouble.
My car just failed the MOT and motability took me off the road until it was fixed, even though as I amseverelyy disabled, it would mean i was pretty much housebound for almost a month.
This is no offence to you but she is being irrisponsible.

Well for starters her car could well be towed away and crushed, councils do not take kindly to having cars without a valid MOT even parked on public roads! There will be a hefty fine and most likely points (or even a ban!) if caught, not to mention a criminal record. Plus if she is involved in an accident whilst driving her car without an MOT her insurance will be void and any accident involving her car will be considered to be her fault! The only exceptions to this are if she is driving either to or from an MOT testing center. Seriously, it isn't worth the risk.

firstly Not having an MOT DOES NOT invalidates her insurance....but they can impound it at a cost of £105 plus £12 per day...they also have to power to CRUSH IT,....
do not use it,you ARE legally allowed to drive it to and from the MOT station...

You MUST stop her using the car without an MOT because her insurance will be invalidated.

PS you can legally take your car for a "booked in" test without a MOT but it must be roadworthy

Her insurance is now invalid. If driven police can now seize the vehicle even if parked in a public place, car park etc. Fine, 6 points -minimum for no insurance, 4-6 points no MoT and heavy fines.
SHE MUST NOT USE THE CAR!! There is no period of grace. 7days to produce docs doesn't apply. The police computer will show lapsed MoT and car seized there and then!!

Penalty? Invalid insurance thus illegal.

Your car may well be confiscated and crushed.

It's very easy to get an MOT in the UK. If the car is in good order, just tell her to book one and get it done.

Not having an MOT also invalidates her insurance, therefore she could be liable to face prosecution for MOT non-compliance, which will be a fine and possible penalty points. If she has an accident her insurance will not be valid.
